A Kenmore man convicted of possession with intent to distribute 40 grams or more of fentanyl and being a felon in possession of firearms and ammunition was sentenced Tuesday to 130 months in prison by U.S. District Judge Richard J. Arcara, according to the U.S. Attorney's Office.
Prosecutor Meghan E. Leydecker said that in April 2022, a search warrant was executed at the residence of 38-year-old Mario Kelly. About 374 grams of fentanyl was seized, along with 7 grams of crack cocaine, drug paraphernalia and three firearms. Kelly, who was previously convicted of two felony crimes in Erie County Court and three federal crimes in the Western District of New York, was legally prohibited from possessing a firearm.
The case was investigated by the Buffalo Police Department and the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives.
