It is known today in at least two image repositories with conflicting and incompatible copyright and licensing terms:
There is no claim that Stewart was working as an employee of the US federal government or that the image was ineligible for copyright for any other reason. To be protected under copyright at the time, the image needed to be published with a copyright notice and had its copyright registered. Unfortunately, we do not know the first publication of this widely-reproduced image. It does not appear to have a separate copyright entry in the Catalog of Copyright Entries for works of art for 1974. If it wasn't registered separately, then the AP's claim to the image will depend on whether it was first published in a source that was itself registered for copyright. Without knowing more about the details of its first publication, we have no way of assessing the AP's claim over this image and must delete under COM:PRP. | |||
