Re:

By his action under Article 270 TFEU, the applicant seeks (i) the annulment of the decision of the Secretary-General of the European Parliament of 15 July 2022 by which the Secretary-General imposed a disciplinary penalty on him (‘the contested decision’), (ii) the withdrawal of the contested decision from his personal file, (iii) reimbursement of the sums deducted from his retirement pension on the basis of the contested decision, including default interest as from the date of the first deduction, and (iv) compensation for the damage which he claims to have suffered due to the contested decision.

Operative part of the judgment

The Court:

1.

Annuls the decision of the Secretary-General of the European Parliament of 15 July 2022 imposing a withholding of EUR 600 per month from the pension of Mr Angel Angelidis for a period of one year pursuant to Article 9(2) of Annex IX to the Staff Regulations of Officials of the European Union;

2.

Dismisses the action as to the remainder;

3.

Orders each party to bear its own costs.
