SDS E-Alert:   Implementation of Amendments to Day Habilitation Regulations Continues to be Suspended

Amendments to Alaska’s Day Habilitation regulations became effective 10/1/20.  These amendments clarify how Day Habilitation services can be included in a Person-Centered Support Plan, and explain what should be contained in support plans and amendments requesting an additional amount of day habilitation beyond 624 hours.   Due to the COVID-19 emergency declaration, Senior and Disabilities Services (SDS) chose to delay implementation of the amended regulations, then issued an E-Alert on 11/24/20 stating that the new regulatory language would become effective 1/1/21.

Most recently, SDS decided to postpone implementation of the amended day habilitation regulations until six months after the end of the COVID-19 public health emergency.    The regulations will continue to be suspended until that time.  An Appendix K waiver requesting postponement of the approved waiver language until this new end date is pending approval by CMS.

Care coordinators should continue to renew and amend support plans with day habilitation services using current COVID methodologies.
