Malibu's Measure R Ruled Illegal By Appeals Court

The court ruled the initiative usurp the city's authority on development matters.

MALIBU, CA — A California appeals court Wednesday upheld a lower court's decision that the voter-approved Measure R that limits development in Malibu.

The 2nd District Court of Appeal ruled the measure, backed by actor Rob Reiner, was illegal. The 2014 initiative restricted chain stores in the coastal city and required voter approval of large development projects.

The court ruled that part of the initiative usurp the city's authority on such matter. The measure would have required the city to submit the plans for every proposed development projects in excess of 20,000 square feet for voters' approval.
