SAN FRANCISCO — A jury trial for a civil case involving a 2-year-old who hit his pregnant mother with a Tesla is set to start this month in Santa Clara County, according to KRON.

Mallory Harcourt was struck in late 2018, the outlet reported, citing the lawsuit and noting she was eight months pregnant when the toddler crawled into the Model X and accelerated up the driveway and into the garage. Harcourt delivered her baby early while suffering from a broken pelvis and also broke a leg, according to KRON, which reported the family is accusing Tesla of negligence and fraud over allegations of flawed software design and the company advertising the vehicle’s technology as safe.

Tesla has denied liability and argued the child pressed multiple pedals and put the gear selector in drive, the outlet reported, adding the company referred to the toddler as “unattended” and noted Harcourt left the key fob in the Model X. Tesla also argued Harcourt's life was likely saved by the vehicle’s driver assistance features, according to KRON.
