FL Killer's Execution Should Not Be Delayed, Prosecutors Say: Report

Prosecutors say a man sentenced to die for rape and murder waited too long to raise concerns over lethal injection, his Parkinson's disease.

FLORIDA — State prosecutors say the execution of a Florida man Thursday should continue as planned as they believe he waited too long to raise concerns regarding Parkinson's symptoms, the Associated Press reported Tuesday.

Loran K. Cole, 57, is set to be executed by lethal injection at 6 p.m. Thursday at the Florida State Prison after being convicted of killing a man and raping the man's sister in February 1994 in Ocala National Forest.

Gov. Ron DeSantis on July 29 signed Cole's death warrant.

Cole on Monday filed a stay request with the U.S. Supreme Court, citing use of a "drug cocktail" may cause him "needless pain and suffering" due to symptoms from Parkinson's disease, the Associated Press reported.

“Cole knew for at least seven years that he was suffering symptoms of Parkinson’s disease but delayed bringing any claim challenging lethal injection as applied to him until his death warrant was signed. Nothing prevented him from doing so,” Florida Attorney General Ashley Moody's office said in a court filing Tuesday, per the Associated Press.

In the stay request, attorneys argued the execution will not be carried out "safely and humanely" due to Cole's Parkinson's symptoms, WFLA previously reported. Attorneys argued the execution may cause "involuntary body movements," the news outlet reported.

Cole was convicted of jumping and robbing two siblings in the Ocala National Forest with a friend - leaving the brother beaten in the forest and taking the sister to a campsite, where Cole was accused of raping her, the Associated Press previously reported, citing court records.

If executed, Cole will reportedly be the first person to be executed in Florida since October.
