Lawyer: Blood Tests Should Be Thrown Out in DUI That Killed Baby

KANE COUNTY, IL —A 25-year-old Carpentersville man accused of driving drunk in a crash that killed a 5-month-old in 2016 is asking that his results from chemical tests not be considered in court, according to the Daily Herald. Brayer Arias-Colazo, 25, of the 100 block of Woodland Circle, allegedly had a blood alcohol content of .099, which is over the legal limit of .08, but passed field sobriety tests following the collision along Route 25 near Silverstone Drive in Barrington Hills.

His lawyer says since he passed the field sobriety tests there was no probable cause to believe he was under the influence but he was still detained and taken to the hospital for a blood and urine draw, according to the article. Police say Arias-Colazo was going 82 mph in a 45 mph zone when he hit another car. A five-month-old, Merdiz Lambert, of Carpentersville, was killed in the crash.

Arias-Colazo is charged with eight counts of aggravated DUI, reckless homicide and speeding in the crash. He is next expected in court on Aug. 23.
