Daily Fantasy Sports Regulations Proposed in Mass.

Attorney General Maura Healey proposed raising the age of players and limiting the amount they can deposit.

Massachusetts Attorney General Maura Healey has proposed regulations for daily fantasy sports, which would allow the game to continue in the commonwealth after some other states have outlawed it.

Healey had previously announced she was investigating the games, including Boston-based Draft Kings and rival FanDuel. Earlier this month, New York Attorney General Eric Schneiderman declared daily fantasy sports to be illegal gambling, despite the industry’s insistence they are games of skill, not chance.

Healey has proposed raising the minimum age to play fantasy sports to 21 instead of its current 18, and the games would exclude college sports. Furthermore, no one directly connected to professional sports would be allowed to play, and players would be limited to depositing no more than $1,000 unless they can prove that they’re financially able to withstand greater losses.

“These regulations are a first of their kind for the daily fantasy sports industry,” Healey said in a statement. “And they focus on protecting minors, ensuring truthful advertising, bringing more transparency to the industry and leveling the playing field for all consumers.”

Healey acknowledged that about 2 percent of players win most of the money, asked FanDuel and Draft Kings to create games that exclude experienced players, giving novices a better chance.

Given the disparity between the talent of players, some have claimed the sites are unfair. Class-action lawsuits have been filed accusing DraftKings and FanDuel of defrauding them, the New York Times reported. Another was filed Wednesday in United States District Court for the Southern District in New York, singling out the banks and credit card companies that processed payments.
