Dearborn Prevails In Lawsuit That Challenged Water & Sewer Rates

The City of Dearborn prevails in an attempted class action lawsuit that challenged its water and sewer rates

DEARBORN, MI- The city of Dearborn has prevailed in an attempted class action lawsuit that challenged the water and sewer rates. Wayne County Circuit Judge Brian Sullivan dismissed all claims made against the city, on Dec. 12.

In a statement from the city of Dearborn, Judge Sullivan had granted the city's motion for a summary disposition and dismissed all of Therese Shaw's claims against the city.

The ruling in Dearborn's favor is coming in sharp contrast to negative publicity prior to the city's November election. There were flyers about the lawsuit that were placed on vehicles in parking lots in Dearborn, with false claims made about the city's water and sewer charges, according to the statement.

The city battled against the unfounded allegations made in the Shaw lawsuit, and were able to win against the case that was raised with getting the claims dismissed.

"This lawsuit was baseless, and we're pleased that justice prevailed, " said Mayor John B. O' Reilly, Jr. "We proved that our residents and businesses can have confidence in the city's application and administration of our water and sewer rates."
