Wahoo's Fish Tacos In Middletown Sued Over Failure To Pay Rent

The owner of that shopping center says Wahoo's owes $16,950 in back rent. Wahoo's said they are working to resolve this.

MIDDLETOWN, NJ — The owners of Middletown Shopping Center (1147 Rt. 35, Middletown Marketplace, where Livoti's is located) are suing Wahoo's Fish Tacos for failure to pay rent.

As of January 16, the landlord says they owe $16,950 in back rent. The landlord filed the suit Jan. 22 in Monmouth County Superior Court.

Joe Hernando, one of the owners, said his business is "working hard to come to an agreement with the landlord," he told Patch Thursday.

Wahoo's has been located there since 2018. They signed a 10-year lease that does not expire until August of 2028. Wahoo's has a liquor license at that location, and serves alcohol.

The Middletown Wahoo's franchise location is owned by three men who live locally, two in Holmdel and one in Hazlet.

According to the terms of their lease, Wahoo's agreed to pay $7,043 a month to the Middletown Shopping Center.

The shopping center owner is seeking the $16,000 in back rent, plus the $2,000 they've had to pay in legal fees to file the suit, for a total of $18,950.
