    I just need some recommendation on a empathetic lawyer or attorney for my husbands injuries.  He was hit on the side by a Huge fedex truck 7 months ago and has suffered so many issues with his back since then to the point to where he is in so much pain that he is considering risky back surgery.  Our lives have changed so much because of all this crap.  My husband went and hired this Bull Shit attorney in San Jose.  When I call, I only get to speak to his assistant who sounds like a chain smoker.  He's already been suckered by them sending him to chiropractic tx and now they wanna send him to their "recommended" surgeons.  Ok, well what about our life?!  We have 4 kids, I am pretty much on my own now cuz my husband can go anywhere due to his pain and not being able to stand for long.  I've had to hire a gardener, house cleaner to help me keep things in order.  My husband looks like he is deteriorating.  Any how, let me just say that I am PISSED.  Now I need take legal action and fire this other stupid law firm he's hired.  Any recommendations would be appreciated.  We are in Fremont, but willing to travel for the right representation.

    You've opened yourself up to a lien from this attorney. Even if you fire him, he is going to assert his rights to a portion of your spouse's settlement (whenever that happens). Like MB H. said, you need to do your OWN research. Take the time to talk to many attorneys so that you can get a good sense whether or not they will be representing you in a manner you like.

    Do not sign anything on the first consultation, and the first consultation should be free. Take your time to make a decision. In some cases, an attorney is not necessary and injury claims can be negotiated directly with the adverse insurance carrier/party.

    If you believe that your current attorney  has failed to provide adequate council in some way, you may wish to file a complaint with the CA State Bar:

    There are several lawyer referral services. Although the CA State Bar cannot refer you to an attorney, they can show you resources that may be helpful in your search:

    Once you are in the process of selecting an attorney, make sure to check for any prior disciplinary actions or administrative citations against them with the State Bar. Not all admonishments are documented, but the majority of egregious issues are noted with great detail. If the attorney you select has been disciplined by the State Bar, you are usually able to read why. You can do so using this link:

    Insurance companies are not there to represent people in bodily injury cases. They are there to defend against liability and/or to resolve first party property claims, or to pay out damages you may have caused as an at fault party. They will not and cannot be an advocate on your behalf as someone who has a bodily injury claim against another party.

    That's very true insurance companies to not come to the aid of the severely injured, the fist thing they're gonna do is try to make it your fault, AAA did that to me with a woman who ran a stop sign and sideswiped me. They suck.

    I can recommend Dr. William Baumgartl as a back specialist, pain manager and surgeon.
