    My Condo was flooded recently by my broken hot water heater.I am having major problems with state farm insurance declineing alot of my claime.They are baseing there assesment on one visit from a woman that agreed with me on all the damange and is now saying it is not what she saw.I don't care how long it takes but I refuse to settle on her opinion alone.I will not become a victium of the insurance scam after 20 years of payments that should cover my loss.

    Who is your agent ? Were pictures taken at the time just after the accident ? Do you have those pictures ? Who was the woman ? You are not telling us the whole story. Are you claiming damage that was not found until after she left ?

    This damage was Sean at the time and pictures were taken. She said the swelling might go down. I told the other agent what she said and his reply was only a flooring contractor could make that call. The flooring contractor stated once the wood has separated and buckled it needs to be replaced. I am telling the whole story at this point and I welcome another agent to check it out.

    I would go to the State Farm web site, and see if there is some mediator with the company that will work with you to get to the bottom of this. Or call Action line in the paper. The few times I made a claim, they were fair with me. Possibly due to your not being a Native English speaker, this is part of the problem. It sounds like time had elapsed between when the leak started, and when steps were taken to clean up the water. It is that time that caused the permanent damage. When repairs are done, make sure the water heater is reinstalled to code, with a separate catch pan that drains to the outside, and a separate drain to the outside for the P&T valve. Some will drain that to the drain pan, but that is not the way to go.

    It is unbelievable that you think that I am a non English speaker from what I have said and that that would matter?This whole event was taken care of in a matter of hours witch inclued removal of the old water heater and instulation of a new one on the spot. The restoration company came in less than two hours. I am sorry that you felt the need to insult me when all I was looking for was feed back on the next action?Thanks for responding ?

    It was the many misspelled words that made me think that. I guess this just speaks about public Schools in the area. Or did you come from a different state ?

    I'm with Sammy; the terrible quality of the spelling, and the fact that you don't even have a picture up, makes hard to believe that you are serious.

    Do not forget KGO "7 on your side" If you feel that you need solid help. Also Fred is correct you can start @ California Insurance Commissioner Complaints.
    Many insurance companies have been sued/fined to make things correct for their own clients. Well homeowners insurance isn't all it's cracked up to be.
    Moving forward.
    1. Tankless water heater - this is a good option if you don't have a house full of people
    2. Always take your own photos. Now you can posted them on your web/fb page until they fix your problem
    3. Don't forget to take photos/video of everything in your home. Store in somewhere save just in case.
    4. If state farm doesn't help you and maybe it's time to change insurance agency.
      We hand state farm but they were never there when we needed them
      We are now with (13years) with CSAA Home/Auto/Road service
    5. Are you talking about flooring or sub flooring or what do you have above your sub floor wood,tile,vin, etc.
    6. have you been under the house yet? Did the water make it down to the ground. Is the sub floor dry yet, do you need to      spray the green stuff etc.

    Sometimes getting it fix 1st, then picking a fight with your insurance company. You will be more sane however you will be out the money for some time. BUT one thing at a time with home ownership. O

    Are they denying your Claim or are they saying the damage isn't covered by your policy. If it is not covered by your policy then it might be covered by the HOA's. What do you CC&R say about damage due to appliances?

    Almost 60 days latter and I still don't even know what they will pay for. The guy in charge claims they don't do E-mail only phone calls or Fax. It is hard to believe? I guess I'll just sit here on a cement floor until they decide to settle my claim. I guess 20 years of paying in case I had a problem,will only be resolved on their decison?

    I have no advice but for everyone on here to raise the deductible on their homeowners insurance- After doing that it now costs me way less every year and if I do ever need it I would just pay the deductible. Chances are I wouldn't even pay the deductible anyways since they usually try and find a way to screw you out of the insurance money.

    I have fought with insurance companies on claims before for my clients. Get a Licensed Contractor in there to give a real estimate and submit it yourself. They of course will argue but I have always gotten my clients a deal they were happy with. Also do you have a copy of their estimate? Sometimes I have been able to look at the insurance companies estimate and point out things that make the estimator look like they are clueless, and then helps us get more money later.

    I feel very lucky right now.   I am with Allstate, and recently suffered 5k of water damage (long story).   The insurance adjustor (different from your agent) made an estimate over the phone and issued a check immediately.   Then moving forward the disaster recovery guys worked directly with that adjustor to settle on a 'negotiated' repair price.      My disaster recovery people took copious pictures as they removed the drywall and ceiling and annotated them with what it showed, eg. mold, or water pooling inside a vent hood, etc.  

    I am surprised you are having so much trouble with STate Farm as they are a highly reputable company.   Your disaster recovery contractor should be doing most of the negotiation and settlement.

    I am still waiting to get dime one for my condo.The restoration company wants to be paid and I am tired of walking on cement floors. The claims agent says he does not have e-mail so all we can do is call and leave messages.The only other option is a fax. We have done both for over two months.Today we found e-mail for the company web site. Two hours latter we got a response? At least now we feel there is someone out there to get this ball rolling?
