    Because if you do, you face 18 MONTHS of house arrest (like most everyone else is doing now anyway) and three years of PROBATION. Imagine facing sanctions if you don't wait 3 years to kill again!

    Almena did not set out to kill anybody. His big crime was to rent warehouse space to people who wanted to live there. Almena -- and the Oakland Fire Department -- looked the other way at the unsafe electrical and heating setups. If Almena was even capable of sensing a safe connection from an unsafe one. Society is trying to make him pay for an accident.

    Further, it was a single event that killed 36 people, not 36 separate events. An "Ooops" that makes a plane crash does not become worse because the flight was full compared to half-empty.

    Anyhow, Almena already served four years for his crime. Another year and a half, plus three years probation, probably is proportional to his guilt here.

    Realize that Max Harris -- who organized the rave and collected money at the door -- went scot-free.

    It was ILLEGAL for anyone to live there. That's the point.
    He knew that, and he illegally jerry-rigged stolen, unsafe AC wiring.

    That's why he's admitting to 36 counts of voluntary manslaughter.  That's what Mehserle was convicted of in killing Oscar Grant.

  1. That would set a bad precedent where it becomes a "take it or leave it" situation wherein the landlord's excuse for not bringing it up to code is "they signed an agreement to indemnify me"

    The actual landlord escaped criminal liability here. The punishment fell on the master tenant.

  2. I was on I-880 North in Oakland that night. I looked over and saw a column of fire and smoke  rising above East Oakland.  I had no idea what was burning.

  3. Wrt to SF housing, if we just trade-off the self-serving interest of landlords that want to artificially suppress supply, we should be able to increase housing with no compromise on safety.

    Also, have only objective housing code instead of subjective ones like "the neighbours decided your design doesn't suit the neighborhood"

  4. Upto code would include among others, structural support to better withstand earthquakes, flood, fire. Removal of asbestos if applicable and possible.
    Could even include installation of water sprinkler if its a multi unit building.
    Not exactly sure what the details are.

  5. They are the ones voting to have very restrictive housing rules in the city.

  6. Lobbying their city council members -- which would be easier if said council members also is a landlord with the same interests.

    If you build more housing,  it will just be diverted to the AirBnB rental aftermarket anyway.

    Meanwhile, nobody is upgrading the infrastructure needed to support the residential capacity we already have.

    There's no lasting genuine shortage.  More and more people capable of paying retail for housing are fleeing the state anyway.
