Unloading delivery truck wakes me up daily at 3 in the night - how do I stop this?

    I have been unable to have a normal night of sleep over a period of at least 5 weeks now.

    My apartment lies on Van Ness Ave and I am able to sleep through regular traffic noise just fine...
    But nearly every day a truck stops in front of my building between 3.00 and 3.30 am, to deliver stuff to the Toyota dealer in the building next door. The unloading is extremely noisy as they use roll cages, and they have no consideration whatsoever for the fact that people are supposed to be in their deepest sleep.

    My eyes are puffy every morning and I am starting to feel the effects of my lack of sleep at work, I am constantly yawning and it is harder to concentrate on my job...  Is it legal to make this much noise at night on a near daily basis?

    It seems to me that they just do not want to pay for a proper permit at the cost of my health. How do I handle this?
    It does not seem to fall under any regular law considering noise at night. All I can find is that the noise is not allowed to be any louder then 5 dB above the ambient sound level.

    And what worries me even more, what if someone actually was blunt enough in the head to give  them a permit to unload at night?
    Should this go at the cost of my health?

    No matter how well intended, I am not looking for advice on thicker curtains or great earplugs.
    I am looking on advice how to actually stop this, as I feel that these practices should be (or are?)  illegal.  :)

    put heavy curtains on the window and foam on the wall or a unuse matteress on the wall it would dampen the sound

    I would think that an apartment on Van Ness wouldn't be for someone that likes quiet nights.

    If it's Toyota, then they are probably doing the repair work that was in the news about the brake peddle or the gas peddle thing. Usually they wouldn't do that. I think that 3 in the morning is a bit too early. I would call the dealership and talk to the manager and ask him why it is so early and see if they can push it back to normal working hours.

    You should move. You live in a busy noisy area. Move to the Richmond. It's kinda akin to people that move near an airport then complain about noise..

    I guess the airport analogy is somewhat true Kelly.
    I sleep through normal traffic noise just fine - windows open or closed, the deliveries started only a few weeks ago.

    Charlene, I would consider a normal human day and night rythm not exactly a schedule.
    There clearly laws for noise at night and I will make use of those...

    3am is too early for noise. Where I live it's silent at night.
