AN ACT
relating to hearings regarding cease and desist orders against
certain persons operating a career school or college without proper
authority.
�������BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
�������SECTION�1.��Section 132.301(a), Education Code, is amended
to read as follows:
�������(a)��The commission may set a hearing on whether to issue a
cease and desist order against a person under Section 132.303 if[:
�������������[(1)]��the commission has reason to believe that the
person is operating a career school or college without a
certificate issued by the commission in violation of Section
132.151[; and
�������������[(2) the person has not responded to more than one
written notice from the commission regarding the person's
noncompliance with Section 132.151].
�������SECTION�2.��This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.��If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
