AN ACT
|
�
|
relating to the disclosure by the Texas Department of Public Safety |
�
|
to appraisal districts of driver's license records and personal |
�
|
identification certificate records, or certain information in |
�
|
those records, for use in determining an individual's eligibility |
�
|
for a residence homestead exemption from ad valorem taxation. |
�
|
�������BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
�
|
�������SECTION�1.��Section 521.049, Transportation Code, is amended |
�
|
by adding Subsections (d) and (e) to read as follows: |
�
|
�������(d)��To assist chief appraisers in determining the |
�
|
eligibility of individuals for residence homestead exemptions from |
�
|
ad valorem taxation under Section 11.13, Tax Code, the department |
�
|
shall provide, without charge, to the chief appraiser of each |
�
|
appraisal district in this state: |
�
|
�������������(1)��a copy of each driver's license record or personal |
�
|
identification certificate record held by the department; or |
�
|
�������������(2)��information relating to the name, date of birth, |
�
|
driver's license or personal identification certificate number, |
�
|
and most recent address as shown in the records of individuals |
�
|
included in the department's driver's license or personal |
�
|
identification certificate records. |
�
|
�������(e)��A driver's license record or personal identification |
�
|
certificate record provided under Subsection (d)(1) may not include |
�
|
information relating to an individual's social security number or |
�
|
any accident or conviction information about an individual. |
�
|
�������SECTION�2.��Section 11.43, Tax Code, is amended by amending |
�
|
Subsection (m) and adding Subsection (m-1) to read as follows: |
�
|
�������(m)��Notwithstanding Subsections (a) and (k), a person who |
�
|
receives an exemption under Section 11.13, other than an exemption |
�
|
under Section 11.13(c) or (d) for an individual 65 years of age or |
�
|
older, in a tax year is entitled to receive an exemption under |
�
|
Section 11.13(c) or (d) for an individual 65 years of age or older |
�
|
in the next tax year on the same property without applying for the |
�
|
exemption if the person becomes 65 years of age in that next year as |
�
|
shown by: |
�
|
�������������(1)��information in the records of the appraisal |
�
|
district that was provided to the appraisal district by the |
�
|
individual in an application for an exemption under Section 11.13 |
�
|
on the property or in correspondence relating to the property; or |
�
|
�������������(2)��the information provided by the Texas Department |
�
|
of Public Safety to the appraisal district under Section 521.049, |
�
|
Transportation Code. |
�
|
�������(m-1)��Subsection (m) [This subsection] does not apply if the |
�
|
chief appraiser determines that the individual is no longer |
�
|
entitled to any exemption under Section 11.13 on the property. |
�
|
�������SECTION�3.��This Act takes effect immediately if it receives |
�
|
a vote of two-thirds of all the members elected to each house, as |
�
|
provided by Section 39, Article III, Texas Constitution.��If this |
�
|
Act does not receive the vote necessary for immediate effect, this |
�
|
Act takes effect September 1, 2007. |
