As a business owner, executive or manager, changes to worker rights is something you need to know. As of today, the new employee ‘right to disconnect’ is starting and a lot of misinformation and opinions are all over social media. We would like to share the facts with you and provide the resources you will need to understand these new workplace changes. For non-small business employees (companies with more than 15 people), starting today, they have a new ‘right to disconnect’ outside of work hours. According to Fair Work, “Employees will have the right to refuse contact outside their working hours unless that refusal is unreasonable. This means an employee can refuse to monitor, read or respond to contact from an employer or a third party”. It's important to understand that these new rights don’t prohibit employers from contacting their employees outside of working hours, but it means the employee has the right to refuse to monitor, read or respond to the contact if that refusal isn’t unreasonable. But what makes an employee refusal unreasonable? Fair Work has provided the following criteria for determining if it is unreasonable: - The reason for the contact - How the contact is made and how disruptive it is to the employee - How much the employee is compensated or paid extra for: * Being available to perform work during the period they're contacted, or * Working additional hours outside their ordinary hours of work - The employee’s role in the business and level of responsibility - The employee’s personal circumstances, including family or caring responsibilities. Or other matters may also be considered. These changes are taking place for non-small businesses as of today, but for small businesses, these changes won’t be implemented until next year, 26th of August 2025.
