When it comes to valuing services and managing variances in matter scope, the legal profession has a long way to go. One of the Lawganised Top 10 tips for law firms to thrive is: “𝗧𝗵𝗶𝗻𝗸 𝗹𝗶𝗸𝗲 𝗮 𝗿𝗲𝘁𝗮𝗶𝗹𝗲𝗿. 𝗩𝗮𝗹𝘂𝗲 𝗮𝗻𝗱 𝗽𝗿𝗶𝗰𝗲 𝘆𝗼𝘂𝗿 𝘀𝗲𝗿𝘃𝗶𝗰𝗲𝘀 𝗮𝗰𝗰𝗼𝗿𝗱𝗶𝗻𝗴𝗹𝘆, 𝗲𝘀𝗽𝗲𝗰𝗶𝗮𝗹𝗹𝘆 𝘄𝗵𝗲𝗻 𝘁𝗵𝗲𝘆 𝘃𝗮𝗿𝘆.” Let us offer a quick analogy to prove this point: The Director of ABC Legal takes her team out to a Chinese Restaurant for a team dinner. They agree to have a banquet of seven dishes at $89 per person. Partway through, the team sees some amazing exotic seafood dishes on another table and asks the waiter to include the three additional dishes in the banquet. At the night's end, the Restaurant Manager charges $119 per person. The ABC Legal Director then: 1. Argues that the banquet fee was quoted as $89 per person, and 2. She says she will fix the bill in 45 days. It would not happen, would it? The same can be said of retail stores that display prices on their products. As a consumer, say, at an electrical retailer, you would not request a specific TV off the wall and then expect the subwoofer and sound bar without those items being added to the price, right? Similarly, many of you may have experienced a builder varying a building contract, or a tradesperson varying their invoice for unforeseen issues that created more work. It happens all around us! So, the same can be said for legal services: Scope your services as detailed as possible, and if the scope creeps or is varied, have the courage to stop and advise your client the scope and fees will be adjusted. And get the funds in trust to cover that variation. We appreciate it is easier said than done, however, do not allow your practice to develop a culture that permits scope creep without compensation. On the odd occasion, it can be acceptable to support a client in a tough spot, we get that. However, if your firm develops a culture of being taken for granted and where scope creep is always absorbed, it can literally cost thousands of dollars every day.
