Are you falling for these common misconceptions about managing leave entitlements for commission-only employees? It's time to set the record straight: Myth #1: Commission-Only Employees Don’t Accrue Leave Entitlements Fact: Under the National Employment Standards (NES), commission-only employees are entitled to accrue annual leave, personal/carer’s leave, and long service leave, just like any other employees. Myth #2: No Need to Track Leave for Commission-Only Employees Fact: Employers are legally required to maintain accurate records of leave taken by all employees, including those on commission-only arrangements. Compliance is key! Myth #3: Leave Entitlements Can Be Pre-Paid Through an "All-Up" Commission Rate Fact: It is unlawful to incorporate leave entitlements into an "all-up" commission rate. Leave must be paid at the time it is taken, not pre-paid as part of any commission arrangement. Myth #4: Changing Employment Status Resets Leave Calculations Fact: Switching from a salaried to a commission-only arrangement does not reset leave balances. Accrued leave carries over without interruption. Myth #5: No Payout for Unused Leave Upon Employment Termination Fact: Upon termination, all permanent employees, including commission-only employees, must be paid any unused annual leave and qualifying long service leave.
