Seven U.S. states have joined forces to challenge the U.S. @Securities and Exchange Commission’s (#SEC) regulation of #cryptocurrency. The states argue in an amicus brief that the SEC's "power grab" would stifle innovation, harm the #crypto industry, and exceed its authority. Earlier this month, the Office of the Attorney General of Iowa announced that Iowa Attorney General Brenna Bird led a coalition of seven states in filing an amicus brief opposing the SEC’s attempt to regulate #cryptocurrencies. The brief, supported by Arkansas, Indiana, Kansas, Montana, Nebraska, and Oklahoma, was filed on July 10 to contest what they view as the SEC’s overreach. The announcement details that “SEC’s power grab may stop states from protecting their citizens from scams, and it hurts the free market.” States like Iowa, which have been proactive in protecting scam victims and prosecuting scammers, see the SEC’s actions as a significant overreach. The Iowa Attorney General’s Office emphasized, “Congress never gave the SEC power to regulate cryptocurrency, and there is no accountability to ensure the actions the SEC takes are legitimate and necessary.” The amicus brief argues that the SEC is violating the Administrative Procedure Act and the Major Questions Doctrine by bypassing Congress. The states contend that typical cryptocurrencies are not investment contracts under the Securities Act of 1934, urging the court to prevent the SEC from exceeding its authority.

OKX, a #crypto #exchange and #Web3 technology company, has announced that Malta will serve as its hub for Markets in #Crypto-Assets (#MiCA) #compliance to meet #regulatory requirements in the European Union. In a press release shared with Cointelegraph, OKX cited Malta’s “high regulatory standards” and the firm’s existing team and infrastructure in the country as key reasons for this decision. Erald Ghoos, OKX Europe general manager, elaborated in an interview with Cointelegraph, noting that the company has held a “VFA Class 4 license in Malta since 2021.” Ghoos emphasized that MiCA will harmonize crypto regulation across all 27 EU member states and 3 additional EEA states. “OKX has a fully operational team in Malta, including local compliance, risk, legal, finance, and senior leadership teams. We have selected Malta as our MiCA hub in preparation for MiCA’s implementation, enabling us to offer regulated crypto-assets access to EU users once MiCA takes effect,” Ghoos stated. The press release highlighted Malta as an “ideal base” for OKX to provide services to EU customers due to its “comprehensive regulatory approach.” OKX plans to offer spot trading to qualified EU residents through Okcoin Europe Ltd, including Euros and Circle USD. The exchange also intends to provide staking services and other trading options to EU residents once MiCA is fully implemented on December 30. Ghoos expressed confidence that the transition to MiCA standards will be “minimal,” reaffirming the firm’s decision to choose Malta as its “home regulator for MiCA passporting.” He also emphasized OKX’s commitment to enhancing user experience by localizing its products and services for local communities. Additionally, OKX will continue to build a localized experience in the EU, ensuring security and transparency by publishing monthly proof of reserves.
