Grumpy Cat files lawsuit against for copyright infringement

Grumpy Cat is coming for what she is due. Grumpy Cat Limited, the company behind the ever-angry feline, filed a lawsuit against Grenade Beverage LLC on Friday for copyright and trademark infringement as well as trademark dilution, cybersquatting, breach of contract, and accounting. The lawsuit demands Grenade to stop using Grumpy Cat naming and imagery for products and sales and seeks damages.

“Ironically, while the world-famous feline Grumpy Cat and her valuable brand are most often invoked in a tongue-and-cheek fashion,” the opening page of the court docs, acquired by EW, reads, “Defendants’ despicable misconduct here has actually given Grumpy Cat and her owners something to be grumpy about.”

The lawsuit alleges Grenade and Grump Cat Limited agreed to produce an iced coffee drink affixed with Grumpy Cat’s likeness called “Grumpy Cat Grumppuccino” in 2013. However, the agreement between the two parties only agreed to that licensing, pending further agreement from Grumpy Cat Limited. The lawsuit states that Grenade established a new item — Grumpy Cat Roasted Coffee — without permission, in addition to Grumppuccino shirts.

In regards to the cybersquatting claim, “grumpycat.com” directs to the coffee website “drinkgrumpycat.com,” an alleged sign of bad faith and exploitation of Grump Cat’s “good reputation and recognizable trademarks.”
