    10 Billion IDR PMA Capital Investment: How it works? Many people are concerned about the minimum capital requirement of Rp 10 billion when they intend to establish or operate a business in Bali or Indonesia. Quite a few individuals have decided against opening a company or invest in Bali due to this issue. In this discussion, we will try to shed some light on this. Regarding the regulation of The Minister of Law and Human Rights number 22 of 2023 about Visa and Stay Permits. In article 40 a residence permit is given to foreign investors from 2 to 10 years, with the condition of investing from US$700,000 to US$5,000,000 (from seven hundred thousand to five million US dollar), which must be fulfilled 90 days from the date the limited stay permit (KITAS) is granted. Commentary from, Mr. Simon Manurung, S.H., the lawyer of Trustworks: "This article does not explain the form of fulfillment [of investment capital]. It is unclear whether it is sufficient to have it on paper through a company deed or as proof of deposit to the bank. Therefore, the form of investment of the capital is not clear. ", - and he added, - "It is also unclear whether the statement of commitment must be realized or if it is sufficient to be stated in the Deed." This means, the goverment did not implement the actual mechanic to checking the investment capital. In actual practice, to obtain a KITAS, the Bali Immigration office requires from the applicant the deposit funds in an account under the name of the company at any local bank, with a minimum value of at least US$2,500 or its equivalent. In our opinion about the Bali economy, we believe that the Indonesian government is not very strict about this rule because it could make difficult for foreigners to open small or medium businesses like restaurants, cafes, or shops in Bali. Small foreigners business create unique Bali ecosystem that attracting many tourist. This flexibility might affect the economy in Bali and even nationwide.
