Plenty of food for thought in the Government's 'Housing for All Expert Group on Conveyancing and Probate: Final Report and Recommendations'. https://lnkd.in/eJK85mBD
The Housing for All Expert Group on Conveyancing and Probate Final Report has some lofty goals to reform Ireland's conveyancing process. Much of it is common sense and what many have been suggesting for years, but is it achievable? A few key takeaways include: - national target of 8 weeks to conclude a typical transaction - quicker turnaround from banks to information requests etc - accelerating the first registration of 300,000 Registry of Deeds titles - "Simple" changes to the law to get rid of "outdated" requirements - Call for full e-conveyancing system end of 2027 It is somewhat vague on what the "simple" changes to the "outdated" legal requirements amount to other than suggestion that e-signatures be allowed in place of wet ones. It also talks about the move away to Statutory Declarations to digital Statements of Truth. Digging down into the detail there are interesting proposals for first registration. Most solicitors dread first registration cases and struggle with Forms 1 and 2. The Report proposes that developers of estates or MUDs on unregistered land convert that title to Land Registry title before offering individual units for sale. This would obviate the need for each individual purchaser of a house or apartment to make the application, reducing the overall workload of the purchasers' solicitors, and more importantly, that of Tailte. This would only apply to situations where the developer is selling unregistered title, and I'm not sure how much landbanks of development potential are currently sat on by developers. There is also talk about "reviewing" the lookback period for planning history of the property (currently 1st October 1964) but I haven't found anything in the report on what this review looks like. Other proposals include extending the loan offer in principle to 12 months, estate agents to flag LPT issues prior to sale, a code of best practice for conveyancers and estate agents, reducing lookback periods for NPPR, and setting up an expedite channel in Tailte to fast track development sites.
