[QUALIFIED INTERMEDIARY REGIME: EXTENSION OF THE QI CERTIFICATION DEADLINES] On August 1st, 2024, the IRS issued a tax alert to the Qualified Intermediaries (QIs) community, announcing an extension of the QI certification deadlines. ➡ Extended Deadlines for Periodic Review Waiver QIs eligible for a QI Periodic Review Waiver concerning 2021 or 2022 now have until November 1st, 2024, to submit their Certification and Periodic Audit Waiver request. ➡ Extended Deadlines for External Review QIs subject to an external review for the QI Application Period 2021-2023, who have selected 2021 or 2022 for the Periodic Review, have their deadline extended to November 1st, 2024. ➡Deadline for 2023 Periodic Review QIs that have chosen 2023 for the Periodic Review must still submit their QI Certification by March 1st, 2025. [UPDATE: IMPORTANT NEW LAW ON TRANSPARENT & PREDICTABLE WORKING CONDITIONS]   The law dated 24 July 24 amending the Labor Code has just been published and will enter into force on 4 August 2024. This law implements Directive (EU) 2019/1152 of the European Parliament and of the Council of 20 June 2019 on transparent and predictable working conditions in the EU and affects the mandatory content of new and existing employment contracts, creates new obligations for the employer and provides specific penalties in the event of non-compliance with these obligations.   Hereafter the main changes foreseen by the law : ➡ Additional mandatory written clauses are required in all employment contracts within Luxembourg ➡ For temporary missions outside Luxembourg exceeding four consecutive weeks, specific provisions must be documented in writing, including details on the host country, remuneration, and relocation allowances ➡ The digitalisation of employment contracts is recognised, provided certain conditions are met. ➡ A maximum duration for the trial period of fixed-term employment contracts is set at a quarter of the contract's fixed duration ➡ Restrictions are placed on the validity of exclusivity clauses that prohibit employees from holding parallel employment outside their normal working hours ➡ A procedure is introduced to facilitate the transition to more secure and predictable forms of employment, such as permanent or full-time contracts ➡ Provisions are established regarding mandatory training that employers must provide to employees to enable them to perform their work Our HR & Employment Advisory Services experts, Karine Pontet Curtat, Patricia Dupuis, Ralf Gilch and Camille Nuss, will be pleased to provide assistance in this respect. 👀💻 Learn more about our HR & Employment Advisory Services here: https://lnkd.in/e9ZSXAQB 👉 #BDOLuxembourg #WorkingConditions #NewLaw #HRServices #EmploymentAdvisory #OurExperts

[IMPORTANT NEW LAW ON TRANSPARENT & PREDICTABLE WORKING CONDITIONS] 👉 New obligations for employers and implications for the drafting of employment contracts.   The bill of law aiming to implement the EU Directive on transparent and predictable working conditions passed the first vote on 26 June 2024 and was exempted from the second constitutional vote. We expect the new law to be published shortly.   Its purpose is to promote more transparent and predictable employment by improving workers' access to key information applicable to their employment relationship.   Employers will need to address the following main changes (under reserve of the final text of the law): ➡ Additional mandatory written clauses will have to be included in all Luxembourg employment contracts. ➡ Temporary mission outside Luxembourg for a duration of more than 4 consecutive weeks è some mandatory provisions will have to be formalised in a written document (among which country of the mission, remuneration and relocation allowances). ➡ Recognition of the digitalisation of employment contracts providing certain conditions are respected. ➡ Setting of a maximum duration for the fixed-term employment contacts trial period è quarter of the fixed duration of the employment contract. ➡ Restrictions of the validity of exclusivity clauses (i.e. clauses prohibiting employees from having a parallel employment outside their normal working hours). ➡ Introduction of a procedure for transition to more secure and predictable forms of employment, such as the transition to a permanent or full-time employment contract, Please keep in mind that only the text of the published law is binding ➡ We will inform when the law is published and enters into force.   Our HR & Employment Advisory Services experts, Karine Pontet Curtat, Patricia Dupuis, Ralf Gilch and Camille Nuss, will be pleased to provide assistance in this respect once the law is published.   👀💻 Learn more about our HR & Employment Advisory Services here: https://lnkd.in/e9ZSXAQB 👉 #BDOLuxembourg   #WorkingConditions #NewLaw #HRServices #EmploymentAdvisory #OurExperts

[INDIRECT TAX NEWS – ISSUE 3/JULY 2024] 💡 BDO’s latest Indirect Tax News is out now! The EU member states could not agree on the VAT in the Digital Age (#ViDA) proposals, which aim to standardise e-invoicing and reporting, because of Estonia's opposition to the measures on the platform economy. Several countries have introduced or proposed mandatory e-invoicing rules for B2B or B2C transactions, such as #Germany, #Latvia, #Malaysia, #Nepal, #Romania and #Zambia. Some countries have also announced transitional or phased implementation of e-invoicing, such as #Poland and #Singapore.
