🌐To benefit from the French and Italian Commercial Exemption (FCE and ICE), certain conditions must be met: ✅️The vessel must be longer than 15 meters. ✅️The vessel must be registered for commercial use. ✅️The owning company must employ a permanent crew onboard. ✅️The vessel must be used exclusively for commercial purposes under a market-rate charter contract (this implies no unjustified trips and no more than a 30% discount off the market price for the owner). ✅️70% of its trips must be conducted outside French or Italian territorial waters during the previous fiscal year. ➡️However, it raises further questions, such as: What constitutes a 'trip'? A 'trip' means any commercial navigation between two events including in national, EU, and international waters, under a charter contract. Sea trials, yacht relocations to shipyards, and static charters cannot be included. The embarkation/disembarkation of charter guests during the charter constitutes an event, thus a new trip, so a charter could include several trips. The ship's log and the guest lists must be precisely maintained to perform this calculation, hence the usefulness of LogNav, which instantly calculates your commercial status and allows you to make the right decisions. *Note that a delivery or redelivery can be counted as trips if these are specified in the contract and charged. This can be an advantage or a disadvantage in your percentage calculation. How is it calculated? Any trip made from January 1 to December 31 of a given year, according to the above definition, can be counted towards achieving the 70% target. What happens for a yacht operating commercially in France during its first season and subsequent ones? The VAT exemption will apply for the first year, although the 70% target must be met. A provisional statement must be provided by the owner confirming that the yacht will continue to meet the FCE requirements, including the 70% trips rule. What if a yacht fails to meet the 70% target in Italy or France? VAT will be applied to all purchases of goods and supplies as well as all work done by Italian or French shipyards. It will still be possible to recover this VAT, though agents apply a cost for this. Non-compliance with FCE or ICE under a provisional declaration or from the previous year N-1 could lead to VAT being applied to the yacht's value as well as potential penalties on January 1 of the following year, highlighting the importance of complying with this rule and having a real-time view of the ship's commercial status with LogNav, whether you are a captain or a manager. And static charters? Static charters do not count towards the trip calculation; however, during a given calendar year, a yacht must undertake more regular charters than static ones, under the 50% rule. Veritax and its agents are, of course, there to keep you constantly informed of legislative changes and to provide information for safe operations in compliance with tax and customs authorities.
