Combined Notice to Public of Finding of No Significant Impact and

Notice of Intent to Request Release of Funds

The purpose of this Notice is to satisfy two separate but related procedural requirements for activities to be taken by the Town of Millington.

On or about August 30, 2024 the above-named Town of Millington will request that the Maryland Department of Housing and Community Development release funds under the Maryland Community Development Block Grant (CDBG) Program to be used for the following pending project award:

Project Title: _Millington Senior Village_______________________________

Purpose of Project: MILLINGTON SENIOR VILLAGE RESIDENTIAL. INFRASTRUCTURE FOR NEW HOUSING. ACTIVITY IS TO CONSTRUCT

ROADS, WATER, SEWER, AND STORM DRAINS TO PROVIDE 52 PERMANENT AFFORDABLE SENIOR APARTMENTS OCCUPIED

BY LMI HOUSEHOLDS. 172 SASSAFRAS STREET, MILLINGTON

MARYLAND 21651.

            Total Project Cost: $18,712,882

Finding of No Significant Impact

Notice is hereby given that the above-named municipality has prepared an Environmental Review Record on the project(s) described in this Notice and has determined that said project(s) will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required, and no further environmental review of the project is proposed prior to requesting the Release of Funds.

The Finding of No Significant Impact is based on the following:(briefly describe reasons for decision)

The Environmental Review Record which documents the Environmental Review of these project(s) is available for public examination at the Town of Millington offices during normal businesses hours.

Public Comments on Finding

All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments regarding the environmental impacts of the described project(s) to the offices of Town of Millington and to the Maryland Department of Housing and Community Development. All such comments must be received no later than August 30, 2024. All comments will be considered, and the Town of Millington will not request the release of funds nor take any action on the project(s) prior to this date.

                                           REQUEST FOR RELEASE OF FUNDS

The Town of Millington will undertake the project(s) described above with Maryland Community Development Block Grant Funds. This Notice also certifies that Kevin Hemstock, serving in the official capacity of Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to environmental reviews decision-making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Town of Millington may use the Maryland Community Development Block Grant Funds and the Maryland Department of Housing and Community Development (DHCD) will have satisfied its responsibilities under the National Environmental Policy Act of 1969.

                                         OBJECTIONS TO RELEASE OF FUNDS

Objections to the release of funds will be accepted by the Department of Housing and Community Development only if one or more of the following apply: (a) that the certification was not in fact executed by the Certifying Officer; or (b) that the Town of Millington has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; or (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by this part before Release of Funds and approval of the environmental certification by DHCD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments to the Town of Millington and to the CDBG Environmental Officer, MD Department of Housing and Community Development, 7800 Harkins Road, Lanham, Maryland 20706. All such comments must be received no later than September 14, 2024.

 

 

TOWN OF MILLINGTON

ADVERTISEMENT FOR BIDS. August 13, 2024

Millington Senior Village Infrastructure (the “Project”)

 

Bids for the construction of certain roads, water/sewer, stormwater management, bio-retention facilities, electric, communications and infrastructure related to the eventual construction of 52 residential apartments for Home Partnership of Cecil County, Inc, (“Developer”), will be received by 10:00 a.m. local time, on Tuesday, September 3, 2024, in electronic format acceptable to Developer and then publicly opened, read aloud and posted on Town of Millington website. The project is comprised of the construction of certain interior roadway, sidewalks, walking paths, water and sewer lines, electric, telecommunication, internet, stormwater management/bio-retention facilities and site utilities necessary to construct 52 residential apartment units in accordance with drawings and specifications dated June 18, 2024.  Bidders proposed schedule must be submitted with bid documents.

 

The domestic procurement preference requirements of the Build America, Buy America Act (BABA) apply to Community Development Block Grant (CDBG) funded infrastructure projects. Specifically, BABA requires:

            1- all iron and steel used in the project must be produced in the United States;

            2- manufactured products used in the project must be produced in the United States; and

            3- construction materials used in the project must be produced in the United States.

 

Federal Section 3 hiring requirements apply to this Project and Section 3 Business Concerns are encouraged to submit proposals.

 

Davis-Bacon labor standards provisions apply to this Project.

Bidders are REQUIRED to attend the telephonic meeting and visit the site. BID OPENING will be held telephonically on Wednesday, September 4, 2024, at 10:00 AM on a call-in phone number provided at the pre-bid conference. A 5% bid bond will be required at the time of proposal submission. BID AWARD will be announced on Friday, September 6, 2024, 2024 at 10:00 AM on the same conference call line as above.

The project is being funded in whole or in part by the Community Development Block Grant program (CDBG). Federal CDBG requirements will apply to the contract. Bidders must clearly demonstrate its qualifications to bid on work and such determination will be at the sole discretion of the Developer. Bidders will be required to comply with Section 109 and E.O. 11246 which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, Anti-Kickback Act, and Contract Work Hours and Safety Standards Act. The Developer is committed to and supportive of efforts to effectively maintain and/or increase the use of Small and Minority/Women-owned Businesses and Historically Underutilized Businesses (HUB) contract participation for Construction Projects, services (including professional and consulting services) and commodities purchases, AND contract participation to offer employment, training and contracting opportunities in accordance with Section 3 of the Housing and Urban Development Act of 1968 (24 CFR Part 135)

For the taxable year beginning July 1, 2024, the Town Council of the Town of Millington proposes to increase real property tax rates from $0.30 per $100 of assessment to $0.33 per $100 of assessment.  A public hearing on the proposed real property tax rate increase will be held at 402 Cypress Street, Millington, MD on May 7, 2024 during the regular monthly Town Council Meeting.  The hearing is open to the public, and public testimony is encouraged.
