The lawyer for Howard Beach bat basher Nicholas “Fat Nick” Minucci – who’s being held without bail – said yesterday that she plans to ask an appeals court to set bail.
Minucci, 19, is being held on charges of hate-crime assault and robbery stemming from last week’s attack on a black man in the Queens neighborhood
But defense attorney Lori Zeno called Judge Lenora Gerald’s decision to remand Minucci unreasonable.
Zeno’s comments came after a scheduled arraignment on additional charges that Minucci’s arrest violated his probation in a 2002 case in which he stabbed a 15-year-old.
The arraignment did not take place because the Department of Correction failed to produce Minucci, who is incarcerated in Rockland County.
