INJURED PEDI-PASSENGER PEDAL-PUSHES A LAWSUIT

A Brooklyn woman says she suffered a serious head injury riding a pedicab through Central Park.

In a likely first-of-its-kind case, Ana Angeli Gutierrez Perez, of Cypress Hills, blames pedi-driver Sherif Hamouda’s “carelessness, recklessness and negligence” for the accident on April 23, 2007.

Her lawsuit claims she was “thrown out of” the pedicab when Hamouda hit a pothole while barreling down an incline near East 72nd Street.

“The guy lost control,” said her lawyer, Stuart Perry, adding that Gutierrez’s “closed head injury” has resulted in headaches, blurred vision and an inability to concentrate.

The suit, seeking unspecified damages, also names the city as a defendant, citing the pothole.

Hamouda could not be reached yesterday.

Fay Leoussis, of the city Law Department, said her office had yet to receive the court filing.

Mayor Bloomberg and Council Speaker Christine Quinn last week announced a deal to regulate the industry, including requiring that all operators be insured and all pedicabs have seatbelts.
