Driver caught with 20 empty vodka bottles told cops he was sober

A driver who was found drunk on a roadside with 20 empty vodka bottles beside his van told cops he had not touched a drop.

Andrew Farr, 55, was arrested after a dog walker told cops a van driver regularly visited the spot in Belcroft Lane, East Yorkshire, and left piles of alcohol bottles behind each time.

The landscape gardener who lives less than three miles away in the area east of Leeds was three times the legal limit of 35.

A court heard he committed the offense two days before Farr was due in court for his second drink driving offence in two years.

Prosecutor James Byatt said: “Police received a report that a male driver was throwing vodka bottles from a Vauxhall Astra van.

“The defendant was in the driver’s seat. The key was in the ignition. He denied he had anything to drink but a roadside breath test was positive.”

On October 5, he was given a 44 month ban, and was fined $156 with $110 court costs and a $39 surcharge after admitting drink driving in June.

He had also been fined and given a 12 month ban following a previous conviction in August 2015.

Defence lawyer Anthony Farrell said Farr’s landscape gardening business had hit a bad patch around the time of the incident.

He added: “I would like to make the point the 20 empty bottles outside his vehicle did not belong to him. It’s a lay-by. They could have belonged to any one.

“Financially, he is in dire straits. He is certainly remorseful for what he has done.”

Farr will have ten points put on his licence when it is returned to him. He was also fined $326 with $110 court costs and a $39 surcharge.
