Republican Reps. Andy Biggs, Paul Gosar subpoenaed in 2020 election probe by Arizona AG: report

Arizona GOP Reps. Andy Biggs and Paul Gosar received subpoenas earlier this year as the Grand Canyon State’s attorney general looks into attempts to unlawfully reverse the 2020 election result, according to a new report.

The congressional allies of former President Donald Trump were issued the subpoenas and ordered to testify before a grand jury as part of Arizona AG Kris Mayes’ investigation of a so-called “fake elector” plot to block Joe Biden’s path to victory, Politico reported on Thursday.

Two sources confirmed the Biggs subpoena to the outlet, which also reviewed a copy of the Gosar subpoena sent on Feb. 16 to Speaker of the House Mike Johnson (R-La.).

A Capitol Hill source told The Post that the Biggs subpoena was never forwarded to the speaker’s office and the Gosar subpoena was subsequently withdrawn.

It’s unclear whether the lawmakers remain potential targets in the probe or whether the pair have shrugged off the documents compelling them to testify.

Neither their offices nor Johnson’s immediately responded to a request for comment.

Mayes’ office has fired off several subpoenas since the start of 2024, CNN reported last month, as part of a grand jury inquiry that could lead to the fourth state-level indictment of Trump allies for their attempts to reverse the presidential election results.

The 77-year-old Trump was indicted last August in Georgia along with 18 co-defendants — some of whom are reportedly connected to the Arizona probe — but the case led by embattled Fulton County District Attorney Fani Willis has been bogged down in a morass of filings alleging prosecutorial misconduct.

In December, Nevada Attorney General Aaron Ford announced the indictment of six Republicans on charges related to submitting false certificates to Congress declaring Trump to have won the state, the Associated Press reported.

Another case against 16 pro-Trump electors is ongoing in Michigan, led by state Attorney General Dana Nessel.

The Arizona, Nevada and Michigan attorneys general, along with Willis, are Democrats and staunch critics of Trump’s claims that the last election was stolen from him by massive electoral fraud.

Biggs and Gosar both challenged the 2020 presidential election results in the House on Jan. 6, 2021, shortly before a mob of Trump supporters breached the US Capitol, temporarily delaying the official count of votes for President-elect Biden and Vice President-elect Kamala Harris.

Gosar was the first member of Congress to object to the electoral count, citing issues with the tabulation of ballots in his home state of Arizona. Along with Biggs and other members, Gosar held a meeting at the White House in late December, just weeks before the “Stop the Steal” rally that led to the Capitol riot.

Biggs also kept in contact with then-White House chief of staff Mark Meadows in the lead-up to the protest, telling him at one point to “encourage the state legislatures to appoint [electors]” and later gathering signatures from fake Trump electors in Arizona, according to a December 2022 report by the House select January 6th committee.
