2nd Man Charged In Evanston Shootout Found With Gun But Did Not Shoot, Police Say

Two people have been charged with illegally possessing a gun as a felon, one of whom was wounded in the last week's gunfight on Dempster.

EVANSTON, IL — A second man has been charged with illegally having a gun in connection with last week's shootout on Dempster Street in Evanston.

Authorities said a 50-year-old Evanston man and 41-year-old Sean Gayle exchanged gunfire outside of Gayle's apartment around 8:30 p.m. on Aug. 5. Evanston Fire Department crews rushed both men to area hospitals.

Gayle was charged with aggravated unlawful use of a weapon by a felon and this week ordered jailed while awaiting trial. And on Tuesday, prosecutors charged another man with aggravated unlawful use of a weapon.

Christopher Davis, 38, of the 8700 block of South Jeffrey Boulevard in Chicago, was pulled over while driving a Volvo on the evening of the shooting, leaving the area of the shooting at Darrow Avenue and Dempster Street, according to police.

Officers reported they noticed a 9mm pistol on the floorboard behind the the driver's seat during the traffic stop.

Police said they detained Davis but released him from custody while the investigation continued.

Once police got a search warrant for the car, they retrieved the gun.

Davis was spotted holding a black gun matching the one found in his car immediately after the shooting, but he is not believed to have fired it.

Investigators believe he had it in his car "in an apparent attempt to take it from the scene," police said.

Police earlier said Gayle and the other man shot each other as part of an "ongoing dispute."

Davis was arrested at the Evanston Police Department on Monday and was due to appear in court Wednesday in Skokie.
