Man Accused Of Giving Twin Brother’s Name At Arrest: Cop Log

CONCORD, NH — David Dubuc, born 1967, of Windham was arrested on two bench warrants at 11:01 p.m. on Dec. 20, 2021, after an incident at Dunkin’ Donuts on South Main Street.

Brycen Robert Horne, born 1998, of Concord was arrested at 12:57 a.m. on Dec. 20 on driving under the influence and operating with an expired license charges after an incident at Cumberland Farms on North Main Street. He was also arrested in September 2021 in Concord on a DUI charge.

Nichole Mercier, 39, a homeless woman now located in Concord, was arrested at 10:15 p.m. on Dec. 18 on stalking, criminal trespass, and violation of a protective order charges. Police were sent to an apartment on Concord Street after a complaint by a man that Mercier and another man were fighting. When police arrived, Mercier and the man had left the building. The man said he let Mercier and the man in to “get out of the snow.” Mercier, the man said, brought bottles of whiskey but he moved one of them away from her so she wouldn’t “become intoxicated,” according to an affidavit. He then accused Mercier of getting upset and pushing him. The other man and Mercier then began yelling at each other and the complainant kicked them out, the report said. The reporting officer spoke with a fourth person who confirmed the comments made by the complainant. Officers began searching for Mercier, found her on Storrs Street, and she denied being on Concord Street but was in possession of whiskey bottles, the same brand the complainant said she had, the affidavit stated. Mercier, instead, said she was coming from an establishment on South Main Street. A man with Mercier was also questioned and he said he was at the Concord Street apartment. A check found that Mercier was trespassed from the apartment by the property manager. Mercier, the reporting officer said, was also not supposed to be with the man she was with at the time of questioning, and that order was active through August 2022. Mercier was then arrested and held without bail.

Raymond W. Sylvester, 76, of Concord was arrested at 6:45 p.m. on Dec. 18 on a failure to comply/knowing sex offender registration-subsequent charge. He was arrested at police headquarters. He pleaded guilty to a duty to inform charge out of Concord in June 2018. Sylvester is a sex offender due to rape convictions in Sullivan County in 2007.

Dorothy A. Desrosiers, born 1943, of Pembroke received a summons at 1:14 p.m. on Dec. 18 on a conduct after an accident charge after an incident at the Steeplegate Mall on Loudon Road.

Jacqueline Ryan Arsenault, 23, of North State Street in Concord, was arrested at 3:26 a.m. on Dec. 18 on a violation of a protective order charge. Police were sent to the Morning Star Condominiums for a report of a domestic violence protection order violation. A woman, who resides in the complex, heard yelling from the parking lot and when checking out to find out what was going on, realized Arsenault, a woman she had a protective order against, was in the parking lot. The reporting officer made contact with Arsenault and claimed she stated she was there, with other friends, in another building, after being at WOW Chicken earlier. Other officers arrived, eyed the complainant’s living room window and the area where Arsenault was, and determined it to be within the 300 feet area where she was not allowed to be, the report said. The protection order, the affidavit said, was active through March 2022. Arsenault was arrested and held without bail.

Michell Olivia Watson, born 1989, of Concord was arrested at 1:25 a.m. on Dec. 18 on a bench warrant after an incident on Loudon Road.

Paige M. Parris, born 2000, of Epsom received a summons at 11:44 p.m. on Dec. 18 on expired license-subsequent and unregistered vehicle charges at 11 S. Main St.

Michael Todd Spaulding, 34, of Warner was arrested at 6:56 p.m. on Dec. 17 on loitering or prowling and resisting arrest or detention charges. He was arrested after an incident at Tru By Hilton on South Main Street.

Cody Richard Merrill, 28, a homeless man now located in Concord, was arrested at 11:27 a.m. on Dec. 17 on a bench warrant and a resisting arrest or detention charge. An officer patrolling the parking lot of the Best Western on Hall Street saw a man facing the door of the hotel. When the man saw the police cruiser, he ducked back into the hotel, the officer wrote. The officer drove to the front of the hotel, saw the man again, and thought it might be someone who had several active warrants. The officer approached the man and asked him his name. “Tyler Merrill,” the man said, according to an affidavit, and then began to walk away. The officer began searching the name and found a caution warning for his twin brother, Cody Merrill, the report said. Cody Merrill had an active warrant on a felony forgery charge from September 2021 out of Merrimack County. Other officers arrived and they found the man in the parking lot of the methadone clinic. He was questioned and then, after matching tattoos to ones on file to Cody Merrill not Tyler, he was told he was under arrest. Cody Merrill, however, began to resist by tensing his muscles and thrusting both arms forward in an effort to avoid being placed in handcuffs, the affidavit stated. After being requested to stop, he did, was cuffed, and taken to police headquarters. He is due back in Merrimack County Superior Court for a dispositional conference on Feb. 15.
