Guilty Plea In Attempted Rape Of Young Child: DA

He admitted he tried to have intercourse with the victim over the last Christmas break, prosecutors said.

PORT JERVIS, NY — A Port Jervis 45-year-old pleaded guilty Monday to attempted rape in a case that involved a child who was less than 11 at the time, Orange County District Attorney David M. Hoovler announced.

At sentencing on Sept. 17, prosecutors will recommend that James Pospisil be sentenced to 15 years in prison to be followed by 15 years of post-release supervision. As part of the sentence, Pospisil will also be registered as a sex offender under the New York Sex Offender Registration Act, Hoovler said.

At the plea proceedings, Pospisil admitted that between Dec. 22, 2023 and Jan. 2, 2024 he did attempt to engage in sexual intercourse with an individual who was less than 11 years old, prosecutors said.

Hoovler thanked the Orange County Child Abuse Investigation Unit for their investigation which led to the arrest of the defendant.

“This defendant’s admitted conduct is a vile and unspeakable act of abuse of an innocent child,” he said. “I hope that the significant sentence the defendant faces will provide a degree of closure to the victim and will ensure that this defendant is unable to harm others. My Office, together with our law enforcement partners, will bring to bear all resources available to us in our pursuit of sexual predators. We will continue to provide support for victims of sexual assault and seek to hold offenders accountable for their actions.”

The case is being prosecuted by Assistant District Attorney Nicholas Mangold.
