Man Who Fired Gun Toward People Convicted Of Weapon Possession: DA

Orange County prosecutors said five people were threatened July 11, 2023.

NEWBURGH, NY — A city resident who fired a handgun five times at people he had just threatened has been convicted on the charge of second-degree criminal possession of a weapon, Orange County District Attorney David M. Hoovler announced Monday.

Frank Baltimore, 36, faces up to 15 years in prison; he is scheduled to be sentenced Sept. 3. Baltimore was sent back to the Orange County Jail without bail following the jury’s verdict, the DA said.

At 1 a.m. July 11, 2023 in the vicinity of Dubois Street, Baltimore made threats to unarmed people in the area and then discharged a loaded 9mm handgun five (5) times in their direction, prosecutors said. The rounds struck a vehicle.

Surveillance video of the incident, as well as the collection of other physical evidence, led law enforcement to identify Baltimore as the perpetrator.

He later told the police that the individual in the video was him, but claimed that the gun he used was a BB gun, prosecutors said.

Hoovler thanked the City of Newburgh Police Department for their investigation which led to the arrest of Baltimore. He also thanked the Orange County Sheriff’s Office who assisted by providing testimony at trial.

“We will not cease our pursuit of dangerous guns in the hands of dangerous criminals,” said Hoovler. “This hard-fought conviction underscores our commitment to ensuring the safety of our communities by identifying and holding accountable those who illegally possess and use firearms. I commend the work of the City of Newburgh Police Department whose investigation led to the apprehension and conviction of this defendant.”
