Orange County Man Admits Selling Fentanyl That Killed His Customer

Authorities said the man pleaded guilty to manslaughter and criminal sale of a controlled substance.

WASHINGTONVILLE, NY — An Orange County man admitted his involvement in the death of someone from a drug overdose.

Orange County District Attorney David Hoovler said that, on Wednesday, Timothy Lempicki, 36, of Washingtonville, pleaded guilty in court to second-degree manslaughter and third-degree criminal sale of a controlled substance in connection with the death of a man who was found dead July 17, 2022, in the town of New Windsor.

An autopsy revealed that the man died due to a fatal overdose of fentanyl.

At the time he made the guilty plea, Lempicki admitted that on July 16, 2022, in the village of Washingtonville, he sold fentanyl to the man who died.

Lempicki also said that, at the time he sold the drug, he knew and consciously disregarded a substantial and unjustifiable risk that the drug might have a lethal effect on the person to whom he sold it.

He is next scheduled to appear in court for sentencing June 24.

Under the terms of the plea agreement, the district attorney’s office will recommend that Lempicki be sentenced to two to six years in prison for the second-degree manslaughter charge and three years in prison and two years of post-release supervision for the third-degree criminal sale of a controlled substance charge.

The investigation into the man’s death was conducted by the Village of Washingtonville Police Department and the Town of New Windsor Police Department, who were assisted by the Orange County District Attorney’s Office and the Orange County Medical Examiner. The matter was investigated and presented to an Orange County grand jury.
