2 Brothers Will Each Go To Prison For Attempted Murder In Westchester

​The siblings, who both have prior convictions, attacked and pistol-whipped their victim before shooting him in the back.

YONKERS, NY — A pair of siblings will pay with years behind bars for the brutal beating and shooting of a Westchester man.

Westchester County District Attorney Miriam Rocah announced that the two Yonkers men were sentenced in Westchester County Court on Thursday to a combined 28 years in prison for the attempted murder of a Yonkers man outside of his home.

"Gun violence inflicts enormous fear and stress in our communities and drivers of this epidemic must be held accountable," Rocah said. "Thankfully, the victim survived this violent attack and shooting, and the defendants now face the consequences for their actions."

34-year-old Daquann Johnson was sentenced to 16 years in state prison, with five years of post-release supervision, while his brother, 32-year-old Dieandre Phillips was sentenced to 12 years in prison, with five years of post-release supervision.

On March 30, after a four-week trial, a jury found the siblings both guilty of felony second degree attempted murder, felony first degree attempted assault, felony second degree criminal possession of a weapon, felony second degree assault, and felony third degree criminal possession of a weapon.

On Jan. 20, 2023, shortly before 12:30 p.m., Johnson and Phillips, who were strangers to the victim, repeatedly kicked and punched him after an argument outside the victim’s Yonkers home. The brothers then hit the victim with a gun before shooting him in the back as he attempted to run into his home.

Yonkers police arrested Johnson the next day, and Phillips on Jan. 24, 2023, following an investigation using surveillance video and license plate readers. Officers also recovered a 9mm shell casing at the scene.

Rocah thanked the Yonkers Police Department for their help on this case.

The case was prosecuted by Major Case Bureau Chief Nadine Nagler and Assistant District Attorney Rachel Ehrhardt, both of the Trials and Investigations Division, with help from the Violent Criminal Enterprise Unit of the DA’s Criminal Investigators Squad.
