Rockland Man Who Beat Up Woman, Fought With Cops Convicted: DA

The injured woman refused to testify, the district attorney said.

SPRING VALLEY, NY — Police called to a domestic dispute at 2:18 a.m. July 1, 2023 in the village, found a woman outside who was bleeding from numerous injuries to her face and body.

They found Michael McCutchen, 32, inside.

There was an active order of protection in effect issued by the Spring Valley village court prohibiting him from being in the presence of the victim or her residence, prosecutors said.

McCutchen became combative, police said. While being escorted out of the residence, he spit at the female victim in the presence of the officers. He refused to be handcuffed and to be placed in their patrol car. Additional units from Spring Valley PD were required to transport him to Spring Valley Police Department headquarters due to his conduct.

At headquarters, McCutchen continued his violent behavior, attempting to bite, shove, and spit at the police officers, prosecutors said.

The victim’s injuries were documented, and she was treated at a local hospital for her injuries.

She refused to testify at McCutchen's trial. Despite that, the prosecutors proceeded with the case, presenting all the other evidence in their possession with the full cooperation and assistance of the Spring Valley Police Department, said District Attorney Thomas Walsh.

McCutchen, who had been previously convicted of second-degree criminal contempt, was convicted April 16 after a two-day bench trial on three charges:

• 1 count of Criminal Contempt in the First Degree
• 1 count of Resisting Arrest
• 1 count of Obstructing Governmental Administration

"The actions of the defendant in this case showed a clear disregard to the well-being of the victim, law enforcement, and the rule of law. Physically attacking someone and causing them injuries will not be tolerated," Walsh said. "I commend the prosecution by Assistant District Attorneys DeLuca and White who overcame many obstacles to secure a conviction and seek justice in a case of domestic violence.”

McCutchen is currently incarcerated in the Rockland County Jail and is scheduled to be sentenced on June 26, 2024. The defendant faces a mandatory minimum of at least 1 1/2 to 3 years and up to 2-4 years in state prison.
