VdA participates in Cyber Summit 2024 Inês Antas de Barros participates as a speaker at the Cyber Summit 2024, which takes place this Tuesday, 9th July, from 9am to 5.30pm, in Lisbon.   The VdA lawyer's participation will take place at the round table dedicated to the debate on the "NIS 2 Directive and the DORA Regulation: Implications for companies and administrators", where the impacts of these regulations on organisations and corporate management will be presented.   The Cyber Summit 2024 aims to promote innovation in the areas of cybersecurity and cyberdefence, bringing together the sector's main stakeholders. Employment & Labour Law 2024 | International Comparative Legal Guide Benedita Gonçalves, Manuel Cavaleiro Brandão, Tiago Piló and Sofia Barros Cortez signed the chapter on Portugal in the International Comparative Legal Guides (ICLG) on "Employment & Labour Law 2024". Through this contribution, VdA's lawyers address a number of crucial labour law issues, including topics such as: "Terms and Conditions of Employment", "Employee Representation and Industrial Relations", "Discrimination", "Maternity and Family Leave Rights", "Business Sales", "Termination of Employment", "Protecting Business Interests following termination", "Data Protection and Employee privacy" and, finally, "Court Practice and Procedure". VdA participates in the E-TEC4Space International Conference Magda Cocco participated as a speaker at the International Conference "E-TEC4Space: Law and Policy Challenges for the Space Domain", organised by the School of Law and the School of Medicine of the Universidade do Minho. This conference, which took place on 6 June, aimed to launch the new research area JusGov - Centro de Investigação em Justiça e Governação, a research and development (R&D) unit at the University of Minho, focused on Law and Public Policy in Space. In this context, Magda Cocco participated in the panel on "The Contemporary Relevance of Space: What Public Policy Priorities?" together with speakers Delfina Soares (UNU-EGOV), Hugo André Costa (Portuguese Space Agency), Pedro Costa (Portuguese Air Force) and moderated by Bruno Reynaud de Sousa (EDUM/JusGov). This event brought together some of the biggest stakeholders in the space sector, with the participation of the keynote speaker, General Pascal from the European Space Agency - ESA, and the Czech Ambassador to Portugal, Dr Martin Pohl. Hoje, dia 5 de julho, foi publicada a Diretiva relativa ao dever diligência em matéria de sustentabilidade (“CSDDD”), entrando em vigor no dia 26 de julho e com transposição nacional até 26 de julho de 2026. Dela resultam deveres de atuação relativamente a Direitos Humanos e Ambiente para empresas europeias e não europeias, designadamente: ·        Deveres de vigilância incorporando processos de diligência devida nas políticas e sistemas de gestão, que considerem efeitos negativos sobre direitos humanos e ambiente relativamente às suas operações, das filiais ou dos parceiros comerciais nas cadeias de atividade, e ·        Adoção de um plano de transição para a mitigação das alterações climáticas para assegurar a compatibilidade do modelo de negócios e da estratégia empresarial com objetivos de uma economia sustentável e limitação do aquecimento global a 1.5°C. A Diretiva será aplicável a empresas com mais de 1000 trabalhadores e volume de negócios mundial superior a 450m€ (ou realizado na UE para empresas de países terceiros), assim como a empresas com contratos de franquia ou de licenciamento recebendo royalties superiores a 22,5m€, desde que tenham um volume de negócios mundial superior a 80m€ (ou realizado na UE para empresas de países terceiros). Today, the 5th of July, the Corporate Sustainability Due Diligence Directive (“CSDDD”) was published and will enter into force on the 26th of July with transposition to domestic law by 26 July 2026. It imposes duties to act relating to human rights and environmental matters to European and non-European, among which: ·        Surveillance duties, incorporating due diligence processes into policies and risk management systems accounting for adverse impacts on human rights and environment concerning its operations, those of subsidiaries or business partners within the chain of activities, and ·        Adoption of a transition plan for climate change mitigation aiming to ensure compatibility of the business model and corporate strategy with the goals to a sustainable economy and limiting global warming to 1.5° C. The Directive will apply to companies with more than 1,000 employees and a worldwide turnover higher than 450m€ (or generated in the EU for third-country companies), as well as to companies that entered into franchising or licensing agreements for royalties higher than 22,5m€ and provided that the company had a worldwide turnover higher than 80m€ (or generated in the EU for third-country companies). Its application will be phased until 2029 considering the size and turnover of the companies. Non-compliance may be punished with fines up to 5 % of the worldwide turnover of the non-compliant company. VdA e ASWP organizam sessão sobre "Alterações legislativas no Setor dos Resíduos" No dia 2 de julho, a VdA Vieira de Almeida e a Smart Waste Portugal organizaram em Lisboa um encontro entre os seus clientes e associados para discutir as recentes alterações legislativas nos domínios da gestão de resíduos e da economia circular, após a entrada em vigor do Decreto-Lei n.º 24/2024, de 26 de março. Marcaram presença João Vieira de Almeida, Assunção Cristas e Catarina Pinto Correia pela VdA, Aires Pereira pela Smart Waste Portugal, Jose Manuel Alho pela CCDR Lisboa e Vale do Tejo e Marta Lima Basto pela Direção-Geral das Atividades Económicas (DGAE), que trouxeram as suas perspetivas sobre as inovações regulatórias e os seus desafios e impactos mas também as oportunidades, designadamente em matéria de inovação, desenvolvimento de novos produtos a partir de resíduos e simplificação dos procedimentos de licenciamento. A mesa-redonda sobre “UNILEX – Desafios e Impactos” contou com a participação de Leonardo Mathias (SDR Portugal), Jorge Henriques (FIPA – Federação das Indústrias Portuguesas Agro-Alimentares), Luís Castanheira Lopes (Pestana Hotel Group) e Leonor Sottomayor (Grupo SONAE), com moderação de Ana Isabel Trigo Morais (Smart Waste Portugal), da qual resultou um conjunto importante de reflexões sobre a adaptação esperada das empresas do setor ao novo quadro legislativo. VdA at the IV Postgraduate Course in Real Estate Law Miguel Marques dos Santos and Chen Chen were invited to teach at the IV Postgraduate Course in Real Estate Law, promoted by the Private Law Research Centre of the Faculty of Law of the Universidade de Lisboa. Miguel Marques dos Santos gave a lecture on "Due Diligence: Essential Aspects of an Investment Operation", as part of the "Real Estate Investment" module. Chen Chen gave a lecture on "Sale and Leaseback Agreement", as part of the "Real Estate Financing" module. VdA at event commemorating the 50th anniversary of 25 April Inês Antas de Barros participated in an event commemorating the 50th anniversary of 25 April, organised by by ANACOM's Workers' Committee. The event, which took place on 1 July, focused on "The Workers' Commissions of the independent administrative bodies in defence of workers and the modernisation and efficiency of the state". Inês Antas de Barros was invited to present the topic: "The importance of privacy and the protection of personal data in the labour context". The event's programme included other panels dedicated to presenting information on labour issues, covering topics such as safeguarding workers' rights and guarantees in administrative courts, the four-day working week pilot project and the cooperative relationship between trade unions and workers' committees. VdA participates in the Arbitration Centre Congress João Vieira de Almeida, Mariana França Gouveia and Miguel Lourenço e Silva are participating at the 17th Congress of the Arbitration Centre, to be held from July 3 to 5 in the Salão Nobre of the Portuguese Chamber of Commerce and Industry. The theme of this edition of the Congress is "Arbitration and Mediation in Perspective", and it will also cover topics such as arbitration and the new frontiers of technology, class actions and third party funding in arbitration, the standards of the arbitrators' duty of disclosure based on the Halliburton/Abengoa case and some successful cases in mediation and recent case law on arbitration. On the first day of the Congress, 3 July, João Vieira de Almeida will be interviewing Mariia Puchyna, Senior Associate at Freshfields Bruckhaus Deringer, on the topic of "Mental health and work-life balance in the legal professional". Miguel Lourenço e Silva will then participate in the launch session of the collective work "Arbitragem, 2 Mundos - Diálogo entre Brasil e Portugal" (Arbitration, 2 Worlds - Dialogue between Brazil and Portugal).
