Employment Law: Portugal | Lexology In Depth Tiago Piló and Helena Manoel Viana sign the chapter on Portugal in the publication "In Depth: Employment Law", by Lexology. This publication analyses the structure and developments of labour law in different jurisdictions around the world. In the chapter on Portugal, VdA's lawyers highlight the high degree of labor protection present in the Portuguese legislation, which prohibits the dismissal of workers without cause. However, even though the employment relationship is generally long-term, workers face a segmentation of the labour market, based on fixed-term contracts, temporary agency work, independent contractors, and outsourcing services. According to Tiago Piló and Helena Manoel Viana, most of the relevant regulations are consolidated in the Labour Code (Law No. 7/2009 of 12 February 2009), and other fundamental laws that regulate issues such as parenthood protection, occupational accidents and sickness and occupational health and safety. This publication's analysis provides a detailed overview of legislative and regulatory changes, as well as the main challenges facing the Portuguese labour market. Warranty & Indemnity insurance: from the buyer's perspective Chen Chen has published an article entitled "Warranty & Indemnity insurance: from the buyer's perspective" in Revista de Direito das Sociedades, a publication of CIDP - Centro de Investigação de Direito Privado from Faculdade de Direito da Universidade de Lisboa. This article addresses the growing interest in taking out warranty & indemnity insurance, which has become an option for buyers and/or sellers when buying and selling companies. Chen Chen proposes an analysis of the application of this insurance in the Portuguese legal context, developing some aspects of insurance law and its correlation with other relevant contractual clauses in the business acquisition process. Flash VdA - Ecodesign for Sustainable Products Regulation The Ecodesign for Sustainable Products Regulation, published on 28 june 2024, establishes a framework to define the ecodesign requirements that products have to comply with to be placed on the market or put into service and introduces the Digital Product Passport, with the aim of improving the environmental sustainability of products. This Regulation also provides for the setting of mandatory green public procurement requirements and rules aimed at preventing the destruction of unsold consumer products. "Does Portugal’s waiver of VAT exemption regime conform to EU law?" Vítor Loureiro e Silva and Duarte Canau are the authors of the article entitled "Does Portugal's waiver of VAT exemption regime conform to EU law?", published by ITR (International Tax Review). This article analyses the main characteristics of the VAT exemption waiver regime, in force in Portugal since 2007, and its compliance with European Union (EU) legislation and principles. Through a detailed analysis of the legal and tax implications of the Portuguese regime, VdA's lawyers clarify that “it is time for Portugal to review its tax policy regarding this regime and ensure compliance with EU law and fundamental principles”. VdA participates in the "Thursdays with Science" initiative Iakovina Kindylidi participates this Thursday, June 18, at 12:00 pm, in the "Thursdays with Science" initiative, promoted by the Fraunhofer Portugal AICOS Research Association. For the past year, the Artificial Intelligence sector has been discussing the political developments leading up to the AI Act’s approval. Now, as the AI Act is entering into force, there is still a lot of misinformation about its scope and the obligations applicable to the various players in the sector. In this session, entitled "AI Act 101: Key Concepts and Next Steps", Iakovina Kindylidi will present the general concepts of the recently approved AI Act, and the fundamental steps that organisations must follow to ensure compliance with the new legal requirements.
