The decision in Centrica Overseas Holdings Ltd v HMRC [2024] UKSC 25 confirms that professional fees incurred by a company in relation to managing certain investments, after a decision was made to sell those investments, are capital and not tax-deductible as expenses of management. This decision from the UK’s highest-ranking court will be significant for many holding companies and investment businesses as it clearly sets out the importance of correctly classifying and characterising expenses. We recently informed you of the major payroll changes which were due to come in from April 2025 to how employers report their employees’ hours worked. HMRC have delayed the implementation and employers can breathe a sigh of relief. HMRC has made a decision that due to delays caused by the General Election, it is considered that employers do not have sufficient time to implement the changes by April 2025 and the implementation date has therefore been delayed to April 2026 at the earliest. It is not clear whether the new government will continue with these proposed changes, and we may see an announcement in the forthcoming budget. We will be providing a further update post Budget Day.
