The modelling industry is buzzing with questions about whether artificial intelligence (AI) will replace human fashion models on the runway. Luxury companies exporting and importing products to Mexico must evaluate if, as part of a licensing agreement, royalties and licence fees for using a product’s IP rights are subject to duty payments, writes Foley & Lardner LLP's MARCOS Carrasco Menchaca. He explains: "We often hear about global companies, particularly those in the fashion, apparel and beauty industry, as title holders of intellectual property rights such as trademarks, trade names, patents and copyrights. Oftentimes, those companies grant licensing agreements to third parties, either related or not, to use their IP rights for the manufacture, distribution and/or marketing of products exported from one country to be imported into another. Diageo’s general counsel, Tom Shropshire, Bird & Bird and Kering’s Italian legal team were among the big winners at our recent Luxury Law Awards programme. Shropshire won General Counsel of the Year, Kering’s Italian legal team was recognised as Legal Team of the Year and Bird & Bird secured Luxury Law Firm of the Year – International Practice. Other winners included Mark Green, head of IP at REVOLUTION BEAUTY, who received the Lifetime Achievement Award, and Adrian Bratt, from Princess Yachts, who secured Business Leader of the Year for his role in the company’s acquisition by KPS Capital Partners. Immaculate Vegan founders Annick Ireland and Simon Bell were honoured as Entrepreneurs of the Year for their work supporting sustainable fashion. Reporter Maura O'Malley's latest luxury dispatch details a potential settlement in the long-running dispute over iconic rock band Nirvana's smiley-face logo and LVMH-owned fashion label Marc Jacobs and art director Robert Fisher. According to documents filed at a Californian district court on 9 July, the parties have agreed to mediators' proposals submitted by Magistrate Judge Steve Kim. The parties have 21 days to draw up the details of the agreement. Nirvana is represented by @Mark S. GenAI may be a boon to luxury brand advertising but Hogan Lovells’ lawyers Helen Trac and Rebecca Horton caution that copyright law may not protect some AI-generated campaigns. As they write in their article, "Brands are well underway in recognising the value GenAI offers. For certain tasks, GenAI can advance the creative process and still allow for copyright protection. Two New York law firms are helping a luxury retailer make its own high-end purchase. Willkie Farr & Gallagher LLP is representing Hudson's Bay Company (HBC), parent company of Saks Fifth Avenue, in its $2.65bn acquisition of rival retailer Neiman Marcus Group (NMG), parent company of Neiman Marcus and Bergdorf Goodman. Sullivan & Cromwell LLP is acting for longtime client Neiman Marcus on the deal.
