Kesha's former producer Dr. Luke asks singer to produce evidence supporting abuse claims as their legal battle continues

As Kesha's legal battle with Dr. Luke presses on, her former producer is demanding that she produce medical evidence to support allegations that he sexually and physically abused her.

According to documents obtained by TMZ, Luke is seeking to have the onetime chart-topper hand over records of all her communications in which she may have accused him of mistreating her.

However, the singer is reportedly against the idea, stating that as she's already asked a judge to throw out Luke's defamation lawsuit against her, the probe would be a wasted exercise.

Last week, Kesha had won something of a victory in their fight, as a judge decided that her claims of sexual assault took precedent over her alleged assailant's defamation suit against her.

A New York Supreme Court judge ruled that the pop star's California sexual assault case against Dr. Luke should move ahead first before considering his counter claims of defamation.

The defamation case, according to The Hollywood Reporter, has been put on pause until further notice.

While Dr, Luke filed his defamation suit in New York, the judge said both lawsuits 'present similar claims with the possibility of inconsistent judgements, and the California case alleges specific California statutory claims.' 

According to THR, the New York judge also pointed out that Kesha and Dr. Luke both reside in California and that the alleged claims of sexual abuse, among other things, took place in that state.

Attorneys for Dr. Luke, real name Lukasz Gottwald, have now filed for an appeal following his decision.

The latest development comes months after Kesha filed a lawsuit for sexual assault and battery against Dr. Luke in October.

Shortly after the 28-year-old filed her suit claiming that Dr. Luke 'sexually, physically, verbally and emotionally abused' her, the producer lodged his own compliant.

He requested a judge dismiss Kesha's claims insisting the allegations are false, the statute of limitations has run out and the parties agreed to handle any 'controversies' in New York, according to New York Daily News.

'(Kesha), who never reported the allegations to any authorities, chose a convenient, long-ago time period for the false allegations because she knew the evidence would show that she and Gottwald have not seen each other in years,' court paperwork filed by Dr. Luke’s lawyers stated. 

Dr. Luke also said that the singer fabricated the supposed incidents in an extortion scheme to get out of an exclusive recording contract.

Her allegations were first in question when a 2011 deposition was unveiled where Kesha swore under oath that she was not sexually abused or drugged by the music mogul.

In the documents, she denied that Dr. Luke ever gave her coke or a date rape drug, despite alleging in her latest lawsuit that he forced her to consume illegal drugs.

At the time Kesha filed the lawsuit, her lawyer, Mark Geragos, explained to TMZ in a statement: 'This lawsuit is a wholehearted effort by Kesha to regain control of her music career and her personal freedom after suffering for ten years as a victim of mental manipulation, emotional abuse and an instance of sexual assault at the hands of Dr. Luke.'

Geragos added: 'The facts presented in our lawsuit paint a picture of a man who is controlling and willing to commit horrible acts of abuse in an attempt to intimidate an impressionable, talented, young female artist into submission for his personal gain. Kesha is focused on moving her life and her career beyond this terrible time.'

The legal matters began following Kesha's treatment at Timberline Knolls for an eating disorder from January until March of 2014.
