An Act Increasing the Maximum Residential Property Exemption and Providing for Annual Adjustments was received on May 8, 2009. The Division of Elections determined that there were a sufficient number of sponsor signatures on May 20, 2009. The application was certified by the Lt. Governor on May 27, 2009. The Division of Elections determined that there were a sufficient number of signatures on October 4, 2001. Legal review was received from the Department of Law on November 8, 2001. The Lt. Governor certified the application on November 9, 2001. In accordance with AS 15.45.140, the initiative petition must be filed by November 19, 2002. The initiative was filed on November 14, 2002. The Lieutenant Governor found the petition to be improperly filed due to lack of qualified signatures on January 13, 2003. Lawsuit has been filed. Lawsuit decision - Division of Elections to qualify signatures from 169 petition booklets that were originally disqualified. Lieutenant Governor Leman certified the petition for this initiative as properly filed on January 6, 2004. A lawsuit was filed to determine which ballot the proposition would appear. Court ruled that the initiative would be placed on the November 2, 2004 general election ballot. This bill would eliminate the brewpub license with its 75,000 gallon annual production cap. Current brewpub license holders would be issued brewery licenses. This bil lifts the restriction that holders of a brewery license or winery license may not also hold a beverage dispensary license or a restaurant or eating place license. A holder of a brewery license, in addition to selling beer to licensees, would be able to sell its beer directly at no more than 2 beverage dispensary or restaurant or eating places licensed to that brewery. Up to 8 gallons of beer could be sold to individuals on the premises.

Initiative on Gas Pipeline Development Authority

This bill would create the Alaska Natural Gas Development Authority (Authority) as a public corporation of the State. The Authority would acquire and condition North Slope natural gas, and construct a pipeline to transport the gas. The Authority's powers would include buying property or taking it by eminent domain, and to issue state tax-exempt revenue bonds. The gasline route would be from Prudhoe Bay to tidewater on Prince William Sound and the spur line from Glennallen to the Southcentral gas distribution grid. The Authority would operate and maintain the gas pipeline, ship the gas, and market the gas.

Should this initiative become law?

State law provides an opportunity to have this decision reviewed in superior court. AS 15.45.240 states that within 30 days of the date on which notice of the determination was given (June 7, 2002), any person aggrieved by a determination made by the lieutenant governor may bring action in the superior court to have the determination reviewed. The deadline for action is July 8, 2002. The deadline has passed for challenge of the Lieutenant Governor's earlier actions on this initiative.

Initiative Moving Location of Legislative Sessions

This bill would move all sessions of the state legislature to the Matanuska-Susitna (Mat-Su) Borough. If facilities fit for these sessions can not be found in that borough, sessions would be held in Anchorage until facilities are available in the Mat-Su Borough. The bill would repeal the requirements that before the state can spend money to move the legislature, the voters must be informed of the total costs as would be determined by a commission, and approve a bond issue for all bondable costs of the move.

01PCOR - "An Act relating to allowable absences from the state for purposes of eligibility for permanent fund dividends."

Municipal Property Assessment and Taxation
This bill sets the value of property at the price that it would bring in an open market between a willing buyer and seller who know the property and current price levels. It allows local governments to set up classes of property based on use. Tax standards and mill rates may differ between classes of property. The bill allows local governments to limit both assessments and taxes. It also allows for property to be exempt in whole or in part from taxes. It allows voters to classify property based on use, and limit assessment and taxation, by local initiative.

The Division of Elections verified the signatures of 30,475 qualified voters. On May 24, 2002, Lieutenant Governor Ulmer determined, in concurrence with the Attorney General's Office, that the Alaska Legislature passed a law, CS HB 56(FIN), which is substantially similar in nature to the initiative. Consequently, the initiative petition is void and will not appear on the ballot (AS 15.45.210).

Under Alaska Statute 15.45.240, within 30 days of the date on which notice of this determination of similarity was given, any person "aggrieved by a determination made by the Lieutenant Governor" may bring action in the superior court to have the determination reviewed.
