Promising discussions on infill development, state roles in local land-use controls, and housing-transit connections emerged at the 2024 ULI/Charles H. Shaw Forum on Urban Community Issues. Leaders from various sectors gathered to tackle solutions for the nation’s dire housing shortages and explore innovative policies to expand housing opportunities. #BilzinSumberg Land Development & Government Relations Partner Anthony De Yurre, Esq, LLM highlighted Florida’s 2023 Live Local Act, which was amended in 2024 to pre-empt local zoning and allow up to 150% of maximum density in commercial, industrial, and mixed-use zones, as a viable opportunity to support affordable housing and mixed-use development with high design standards statewide. #BilzinSumberg Tax & Private Wealth Partner Shawn Wolf explains the U.S. Supreme Court's decision in Moore v. U.S., involving corporate and U.S. individual taxpayers who owned shares in a controlled foreign corporation and were subject to the so-called “transition tax” of Internal Revenue Code Section 965. The Court upheld the constitutionality of IRC Sec. 965, stating that “Congress has long taxed shareholders of an entity on the entity’s undistributed income, and it did the same with [IRC Sec. 965]. This Court has long upheld taxes of that kind, and we do the same today with [IRC Sec. 965].” Read more: https://bit.ly/3VzksK1

#BilzinSumberg Real Estate Partner Joe Hernandez speaks with Fox Business Network correspondent Danamarie McNicholl on the recent condo crisis as nearly 1 million condo units have been impacted by new inspection regulations. As inspection results come in, condo associations will see the scale of the problem and have to allocate repair costs among unit owners. “The only logical next solution is to sell the property to a developer that can pay the amount that’s going to not only compensate the unit owner for the value of their unit but also pay-off the loans on those units,” explained Hernandez. #BilzinSumberg Trial & Litigation Attorneys Robert L. Raskopf, Kenneth Duvall, Megan Barney, and Patricia Patino examine the US Supreme Court's decision to remand cases from Florida and Texas concerning laws that limit social media platforms' content moderation back to the lower courts. The Bloomberg Law article highlights that the Court's guidance suggests that social media communications and their moderation are protected under the First Amendment. The decision highlights the ongoing legal debate about whether social media companies can be treated like common carriers, which would require them to allow all content without discrimination. The cases will return to the lower courts for further analysis, with significant implications for the future of digital communication and free speech. The #FederalTradeCommissions’ final rule on non-competes, effective September 4, 2024, outlaws most agreements nationwide, with a handful of exceptions. While employers must notify workers that existing non-competes are unenforceable, they are advised to hold off on sending notices until closer to the deadline due to the pending legal challenges. Condo ownership across #Florida has become more expensive, potentially changing the demographics of neighborhoods and leading to condo terminations. The combination of skyrocketing insurance costs, association fees, and eye-popping special assessments implemented as a result of the tragic collapse of Champlain Towers South in Surfside is driving owners in older buildings to contemplate selling. In Brian Bandell’s latest for South Florida Business Journal, #BilzinSumberg Real Estate Partner Joe Hernandez weighs in on the implications of rising costs for condo owners and how a recent legal decision is challenging the condo termination landscape. #BilzinSumberg client CMC Group has secured $70 million in financing for 4000 Ponce, a mixed-use building that is home to luxury auto dealership The Collection and which has been an anchor of activity in Coral Gables since it was first developed. The Bilzin Sumberg team of Hannah Lidicker and Jim Shindell represented CMC Group, which is led by developer Ugo Colombo. City National Bank of Florida provided the loan and JLL Capital Markets handled the brokerage. “Today’s capital markets are at historically restrictive levels. Securing financing requires some combination of a best-in-class sponsor, a high-performing asset, and real estate market dynamics that are desirable in the eyes of a lender. In the case of CMC Group and 4000 Ponce, this loan checked all three boxes,” explained Lidicker. Read more via Law360: https://bit.ly/4d00xLj
