Today, USDC MA Judge Nathaniel Gorton entered a final order approving a landmark cross-disability Settlement Agreement in Marsters v. Healey. CPR and its partners, Greater Boston Legal Services, Justice in Aging, and Foley Hoag LLP, brought the Marsters disability rights class action lawsuit against the Commonwealth on behalf of tens of thousands of individuals with disabilities who are unnecessarily institutionalized in nursing facilities. The Agreement will allow thousands of people to return to the community and live in new homes with appropriate services. We congratulate the plaintiffs, including the Mass Senior Action Council, and the class they represent, on this important victory!

Today, CPR and Massachusetts signed a landmark Settlement Agreement that will provide residential programs so that thousands of people with disabilities who are unnecessarily segregated in nursing facilities can return to their families and communities. After months of mediation, CPR and its partners, Justice in Aging, Greater Boston Legal Services and Foley Hoag, LLC, signed an Agreement with the Governor and other state officials that will expand community opportunities for people with disabilities in nursing facilities. https://bit.ly/43YOWZJ

Today, CPR and its co-counsel team filed litigation on behalf of Medicaid-eligible children in Georgia who are being deprived of the mental health services they need to treat their conditions and to remain at home with their families. The class action complaint alleges systemic violations of federal Medicaid law, the Americans with Disabilities Act, and the Rehabilitation Act of 1973, including the failure of responsible government agencies to provide and arrange for medically necessary home and community-based services and to prevent the unnecessary institutionalization of the plaintiff class. As detailed in the complaint, and in its accompanying press release, this inability to access care has devasting impacts on the individual plaintiffs and other children like them, including repeated mental health crises, avoidable hospitalizations and out-of-home placements, and involvement in the child welfare system. CPR brings this case with the Georgia Advocacy Office, the National Health Law Program, and two private firms: Kilpatrick, Townsend & Stockton, LLP, and Duane Morris, LLP.
