    Every day, people trust healthcare professionals with their lives. Most of the time, they receive quality care. However, there are instances where the care provided falls below acceptable standards. This is known as medical malpractice. Medical malpractice occurs when a healthcare professional fails to provide the level of care that a reasonably careful professional would under similar circumstances. This can involve taking inappropriate actions or failing to take necessary actions, often resulting in serious injury or even death. So, what should you do if you or a loved one has received medical treatment that might qualify as malpractice? First and foremost, obtaining all your medical records related to your care is crucial. This includes: ▪ Operative reports ▪ Physician and nurse notes ▪ Vital signs ▪ Imaging results ▪ Blood tests ▪ Records from prior office visits – essentially your entire medical chart from the first to the last date of service. These records are vital in any medical malpractice lawsuit, as they provide the necessary evidence to prove whether malpractice occurred. In Illinois, before a medical malpractice lawsuit can be filed, a medical professional in the same field as the treating provider must sign an affidavit stating that malpractice likely took place during the care. If you believe you have a case, gathering your medical records in advance will help any attorney you consult review your claim more quickly and efficiently.

    As football season kicks off around the country it is crucial to remember the risks associated with sports, especially in the summer. Recent news has highlighted an alarming pattern — several youth and high school football players have lost their lives to sudden cardiac arrest (SCA) and heat exhaustion. As the father of former student-athletes who played youth, high school and college football, this news hits home. Sadly, many programs are understaffed and crucial emergency protocols are often underdeveloped or not properly communicated. It is time for parents, schools, and athletic programs to take immediate action: We must prioritize the safety of our young athletes by bolstering emergency action plans and ensuring that all staff are thoroughly educated on how to respond to life-threatening scenarios. It’s especially critical we reconsider the risks of practicing or playing in extreme heat. We need to educate our young athletes about the importance of proper hydration, self-care, and recognizing the early signs of heat exhaustion, heat stroke and SCA. This is not just about improving protocols—it's about saving lives—which is why our family and staff at Dolan Law are big supporters of the just1mike foundation: A nonprofit dedicated to spreading the word about SCA and advocacy to make real change by sponsoring free heart-screenings, installing AEDs, and educating the public on CPR training (link in the comments below).     Dolan Law, law clerk George King discusses the recent CPSC ruling holding Amazon legally accountable for hazardous third-party products. The Consumer Product Safety Commission (CPSC) has recently determined that Amazon is legally accountable for hazardous products sold by third-party sellers on its platform and shipped through its fulfillment services. In a unanimous decision, the CPSC classified Amazon as a "distributor" of defective items, including hairdryers and faulty carbon monoxide detectors. This ruling assigns Amazon the legal obligation to manage the recall of over 400,000 affected products. The CPSC has mandated that Amazon establish a comprehensive system for notifying customers who purchased these unsafe items and implement measures to remove them from circulation, such as offering incentives for their return or destruction. Despite this ruling, Amazon has announced plans to contest the decision in court. As a significant entity in the U.S. e-commerce sector, with approximately 40% of the market share, Amazon functions both as a direct retailer and a platform for nearly 2 million third-party sellers. The company has been challenging its designation as a "distributor" since 2021, following a lawsuit from the CPSC regarding its role in distributing unsafe products. Three years ago, when Amazon was first notified about the defective products, the company responded promptly by informing customers, advising them to stop using the items, and issuing refunds. However, the CPSC argues that Amazon's efforts were insufficient. The agency criticized the company for failing to effectively encourage the return or destruction of the hazardous products, noting that communications regarding safety issues were described as having "potential" risks rather than confirmed dangers and that refunds were substituted with store credits. The recent CPSC ruling reaffirms Amazon’s distributor status under the Consumer Product Safety Act, upholding the administrative law judge's earlier decision.

    Civility in our practice and workspaces starts with us. We can’t expect to receive what we don’t give in return. If we walk around in negativity, it is really hard to be empathetic, open, and willing to see another’s point of view, without rushing to judgment or criticism. As lawyers, our attitudes directly influence our interactions with clients, colleagues, and the court. Negativity breeds hostility and undermines the professionalism that is essential in our practice. What can we do? First, we can begin by accepting our own humanity and the fact that we will have bad days that impact on our state of mind. But, by accepting where we are and maintaining a growing awareness that the state of mind, we are presently in is not fixed, we can begin to make mental strides towards changing it. That is a gift that we all have, the ability to accept where we are, and become more in tune with how we feel. This gives us the space to soften our thoughts and emotions by understanding that they do not last, will pass, and do not define us. Try it next time you start to go into a negative spiral. We can change what we are aware of.

    Electronic bikes are cheaper than cars, don’t require gas, and are eco-friendly. However, is riding e-bikes worth the risk? In Illinois, e-bike laws are vague. The use of electronic bicycles is subject to local regulations, not just state laws. Illinois law says, “A person may operate an e-bike upon any bicycle path unless the municipality, county or local authority with jurisdiction prohibits the use of e-bikes or a specific class of e-bike on the path.” Illinois law allows the use of e-bikes but leaves users guessing about local ordinances. Many e-bike riders fail to appreciate the risk associated with the instant gratification of operating an e-bike.  Some classifications of e-bikes being able to reach speeds of nearly 30 miles per hour. Underage riders often ride without a helmet or on the back of another user’s bike. Reports of fatalities with helmets are still common, according to the Washington Post; a twelve-year-old in California died in an e-bike crash after riding on the back of an e-bike with her friend.  Not only are young users of e-bikes at significant risk of injury or death if not extremely careful, but e-bikes also pose a risk to pedestrians.  According to Reuters report, e-bike injuries are three times as likely to involve accidents with pedestrians as opposed to traditional biking accidents. From 2017 to 2021, e-bike injuries spiked 127 percent, and deaths rose from five to 48 percent, according to a United States Consumer Product Safety Commission study. The popularity of e-bikes will continue to rise. However, the implications of young people operating an e-bike remain to be fully seen. Should you or your child invest in an e-bike, be sure to fully understand what you are purchasing, and more importantly, take the proper precautions to inform your child what they are riding in order to avoid possible consequences. #electricbikes #ebikes #ecofriendly #bikesafety #Illinoislaws #dolanlaw
