The recently announced UK tax changes under the Labour Government, which follow on from proposals in March 2024 by the Conservative Government, could have a significant impact on individuals who are UK tax resident but domiciled outside the UK as a matter of general law and any trusts they have settled. The changes are due to take effect on 6th April 2025. There are complexities to the new provisions, which include a residence-based test to replace the remittance basis of taxation for foreign income and capital gains and the likely loss of inheritance protection for trusts with long-term UK resident settlors.
