✨FosterThomas Wisdom Wednesday✨ Demystifying the Regular Rate of Pay in Payroll In the payroll world, defining the "regular rate of pay" and understanding its importance is essential. If you're part of a payroll department with basic processing, you might not be familiar with this term. Under Fair Labor Standards Act (FLSA) regulations (29 CFR §778.102), overtime pay for hours worked beyond 40 in a week must be calculated at one and one-half (1½) times the regular rate of pay. You might think, "My payroll system does that automatically." But does it? Is your system accounting for everything that needs to be considered? Payroll systems typically take 1½ times the hourly rate. For instance, if Joe makes $15 an hour and works 45 hours in a week, the system might calculate: (40 x $15) + (5 x ($15 x 1.5)) = $600.00 + $112.50 = $712.50. With no other pay components, this seems fine. However, various pay components must be considered for accurate overtime calculation. Components to include in the regular rate of pay are shift differentials, nondiscretionary bonuses, payments in non-cash forms, retroactive pay, on-call pay, and supplemental disability. Exclusions include gifts, reimbursed expenses, payments for time not worked (like sick leave or holidays), stock options, discretionary bonuses, bona fide meal periods, benefits or perks, show-up pay, call-back pay, and state/local regulated payments. Consider Joe again, with a $0.75/hour night shift premium and a $50 nondiscretionary bonus. To calculate the regular rate of pay: 45 hours x $15/hour = $675.00 + 45 hours x $0.75/hour = $33.75 + $50 bonus = $758.75 (regular pay). Divide this by hours worked: $758.75/45 = $16.86 (regular weekly rate). Next, calculate the overtime premium: $16.86 x 50% = $8.43. Multiply by overtime hours: 5 x $8.43 = $42.15. Total pay is then: $758.75 + $42.15 = $800.90. You might wonder, why not use the regular rate of pay times 1½ for overtime hours? The one-times rate is already included in the regular pay calculation, so you only need the overtime premium at 50%. Bottom Line: Ensure all components required under the FLSA are included when calculating overtime pay to stay compliant and fair. #Payroll #HR #FLSA #Compliance #EmployeeCompensation #RegularRateOfPay #OvertimePay #FairPay
