Participants in the hubzone program should take notice of this recent proposed SBA ruling. There are several changes to watch out for including company eligibility and employeee involvement.
There were so many changes in this rule, it was hard to pick out one thing. In this post, we've highlighted a few major changes that would come about from this proposed rule. These include (1) HUBZone eligibility would be checked at time of each offer, (2) HUBZone employees would need to work 80 hours per month, and (3) "Any disqualifying size or status recertification precipitated by [new] § 125.12(a) or § 125.12(b) . . . renders a concern ineligible for future set-aside or reserved awards, including awards of set-aside or reserved orders against pre-existing unrestricted or set-aside multiple award contracts. Additionally, in support of this interpretation, SBA proposes to allow requests for size determinations following any size recertification made in §§ 125.12(a) and (b) as well as those is requested by a contracting officer as set forth in § 125.12(c)." This last would significantly change how recertifications work on IDIQ contracts.
